Comparative Law In Legislative Drafting written by Nicola Lupo and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014 with Bill drafting categories.

This volume examines whether contemporary parliaments use foreign and comparative law in the legislative process. The research reports covered in the book apply the same methodological approach, focusing on the information apparatus available to the legislators, and on the rules and practices that regulate the drafting and approval of bills. Subsequently, it examines several examples of recent legislation in which foreign law has been taken into consideration: in an explicit or implicit way, in order to be accepted or refused, according to a mere instrumental aim or following a rigorous comparative methodology. The book's contributions are from experts in the field covering the following jurisdictions: the US, the UK, Canada, Australia, the European Union, Israel, Italy, Spain, Romania, South Africa, Portugal, Brazil, Namibia, and China. They give valuable insights into how legal transplantation and synthesis take place and whether it is a coherent and valuable practice.

Processing The Past written by Francis X. Blouin Jr. and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2012-12-18 with History categories.

Processing the Past explores the dramatic changes taking place in historical understanding and archival management, and hence the relations between historians and archivists. Written by an archivist and a historian, it shows how these changes have been brought on by new historical thinking, new conceptions of archives, changing notions of historical authority, modifications in archival practices, and new information technologies. The book takes an "archival turn" by situating archives as subjects rather than places of study, and examining the increasingly problematic relationships between historical and archival work. By showing how nineteenth- and early twentieth-century historians and archivists in Europe and North America came to occupy the same conceptual and methodological space, the book sets the background to these changes. In the past, authoritative history was based on authoritative archives and mutual understandings of scientific research. These connections changed as historians began to ask questions not easily answered by traditional documentation, and archivists began to confront an unmanageable increase in the amount of material they processed and the challenges of new electronic technologies. The authors contend that historians and archivists have divided into two entirely separate professions with distinct conceptual frameworks, training, and purposes, as well as different understandings of the authorities that govern their work. Processing the Past moves toward bridging this divide by speaking in one voice to these very different audiences. Blouin and Rosenberg conclude by raising the worrisome question of what future historical archives might be like if historical scholars and archivists no longer understand each other, and indeed, whether their now different notions of what is archival and historical will ever again be joined.

Why We Should Call Ourselves Christians written by Marcello Pera and has been published by Encounter Books this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011 with Political Science categories.

The intellectual and political elite of the West is nowadays taking for granted that religion, in particular Christianity, is a cultural vestige, a primitive form of knowledge, a consolation for the poor minded, an obstacle to coexistence. In all influential environments, the widespread watchword is “We are all secular” or “We are all post-religious.” As a consequence, we are told that states must be independent of religious creed, politics must take a neutral stance regarding religious values, and societies must hold together without any reference to religious bonds. Liberalism, which in some form or another is the prevailing view in the West, is considered to be “free-standing,” and the Western, liberal, open society is taken to be “self-sufficient.” Not only is anti-Christian secularism wrong, it is also risky. It's wrong because the very ideas on which liberal societies are based and in terms of which they can be justified—the concept of the dignity of the human person, the moral priority of the individual, the view that man is a “crooked timber” inclined to prevarication, the limited confidence in the power of the state to render him virtuous—are typical Christian or, more precisely, Judeo-Christian ideas. Take them away and the open society will collapse. Anti-Christian secularism is risky because it jeopardizes the identity of the West, leaves it with no self-conscience, and deprives people of their sense of belonging. The Founding Fathers of America, as well as major intellectual European figures such as Locke, Kant, and Tocqueville, knew how much our civilization depends on Christianity. Today, American and European culture is shaking the pillars of that civilization. Written from a secular and liberal, but not anti-Christian, point of view, this book explains why the Christian culture is still the best antidote to the crisis and decline of the West. Pera proposes that we should call ourselves Christians if we want to maintain our liberal freedoms, to embark on such projects as the political unification of Europe as well as the special relationship between Europe and America, and to avoid the relativistic trend that affects our public ethics. “The challenges of our particular historical moment”, as Pope Benedict XVI calls them in the Preface to the book, can be faced only if we stress the historical and conceptual link between Christianity and free society.

Carlo Pisacane S La Rivoluzione written by Carlo Pisacane and has been published by Troubador Publishing Ltd this book supported file pdf, txt, epub, kindle and other format this book has been release on 2010-10-04 with Italy categories.

Pisacane has been described in English text books and by a number of historians as a key person and in one case as ‘one of the most intelligent leaders’ of the Risorgimento, yet little has been written about him in English. This work therefore aims to introduce this soldier, writer, freedom-fighter and martyr of the Sapri Expedition to an English readership. The introduction tells us about Pisacane’s life and career, including his part alongside Mazzini and Garibaldi in the Roman Republic. It also surveys his written work which evidenced the development of his political thinking and culminated in his Saggi-storici-politici-militari sull'Italia, published posthumously between 1858–1860. La Rivoluzione later published separately was a call to avoid the mistakes of earlier bourgeois revolutions, insisting on the need for an overtly socialist programme to involve the masses in a specifically Italian revolution. Finally, the introduction attempts to set the translated work in the context of post-Enlightenment political thought, as well as contrasting Pisacane’s approach with the mainstream nationalist and republican movements in Italy.

Fascism And Criminal Law written by Stephen Skinner and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-02-26 with Law categories.

Fascism was one of the twentieth century's principal political forces, and one of the most violent and problematic. Brutal, repressive and in some cases totalitarian, the fascist and authoritarian regimes of the early twentieth century, in Europe and beyond, sought to create revolutionary new orders that crushed their opponents. A central component of such regimes' exertion of control was criminal law, a focal point and key instrument of State punitive and repressive power. This collection brings together a range of original essays by international experts in the field to explore questions of criminal law under Italian Fascism and other similar regimes, including Franco's Spain, Vargas's Brazil and interwar Romania and Japan. Addressing issues of substantive criminal law, criminology and ideology, the form and function of criminal justice institutions, and the role and perception of criminal law in processes of transition, the collection casts new light on fascism's criminal legal history and related questions of theoretical interpretation and historiography. At the heart of the collection is the problematic issue of continuity and similarity among fascist systems and preceding, contemporaneous and subsequent legal orders, an issue that goes to the heart of fascist regimes' historical identity and the complex relationship between them and the legal orders constructed in their aftermath. The collection thus makes an innovative contribution both to the comparative understanding of fascism, and to critical engagement with the foundations and modalities of criminal law across systems.
