Ces lignes directrices, préparées par le Comité européen de coopération juridique (CDCJ) et adoptées par la Comité des Ministres du Conseil de l'Europe le 16 juin 2021, sont destinées à aider les 47 États membres de l'Organisation à améliorer le fonctionnement de leurs mécanismes de règlement en ligne des litiges (RLL) dans les procédures judiciaires civiles et administratives, et à faire en sorte que ces mécanismes soient accompagnés de solides garanties en matière de droits de l’homme et soient compatibles avec les principes essentiels d’un procès équitable et d’un recours effectif – articles 6 et 13 de la Convention européenne des droits de l’homme – tels qu’énoncés dans la jurisprudence de la Cour européenne des droits de l’homme. Cet outil juridique pratique fournit des orientations en matière de procédure équitable – accès à la justice, égalité des armes, preuves, procédure efficace, prononcé de la décision, droit à une décision motivée, exécution des décisions et droit à un contrôle juridictionnel dans les affaires impliquant des décisions entièrement automatisées –, de transparence concernant l’utilisation du RLL et d’exigences en matière d’audition, ainsi que sur des questions particulières, telles que la cybersécurité et la protection des droits de l’homme, y compris la protection des données à caractère personnel.
