Il volume nasce dalla volontà di unire competenze e sensibilità diverse per posare lo sguardo sull’universo femminile “ristretto”, multiforme e nello stesso tempo dotato di una forte identità comune. L’attenzione si sofferma su fattispecie restrittive che rispondono a ragioni diverse, si consumano secondo modalità e tempi propri ed entro luoghi di esecuzione specificamente dedicati. Nessuna di esse, però, può legittimamente abdicare al corredo garantistico attraverso il quale l’art. 13 della nostra Costituzione dà sostanza all’inviolabilità della libertà personale. Tutte, invece, debbono rispettare il principio di eguaglianza, che non tollera il dissolversi forzato delle diversità sotto un trattamento ciecamente comune: la considerazione delle differenze di genere è una condizione essenziale della parità di genere. Nel volume s’incrociano modi diversi d’intendere tale differenza e di accostarsi ad essa nella valutazione dei presupposti e nella disciplina dei modi della restrizione della libertà personale nei confronti dell’universo femminile. Alcuni contributi retrospettivi s’incaricano di consentire uno sguardo sulle costanti e sulle variabili che hanno fino ad oggi segnato il cammino delle donne ristrette nel contesto italiano. Sono oggetto di attenzione specifica la restrizione femminile all’interno degli istituti penitenziari e le alternative al carcere, soprattutto legate alla maternità; l’internamento negli ospedali psichiatrici giudiziari e la transizione alle residenze per l’esecuzione delle misure di sicurezza; il trattenimento nei centri di permanenza per i rimpatri (ex C.I.E.). Tutte le realtà considerate descrivono comunità numericamente esigue. Rispetto agli uomini sono poche le donne detenute, internate, trattenute. E tuttavia esse sono portatrici di esigenze specifiche, che attendono risposte adeguate. I “piccoli” numeri della popolazione femminile a vario titolo ristretta favoriscono forme di concentrazione delle donne entro un numero limitato di strutture appositamente dedicate. Ne scaturiscono conseguenze di segno diverso, come testimoniano i contributi presenti nel volume. Possono risultare agevolate la considerazione delle specificità legate al genere e la ricerca di modelli d’intervento adeguati oppure possono consolidarsi forme di ghettizzazione ed emarginazione. Al fine di ricostruire lo stato dell’arte e rilevare punti di forza e criticità attraverso un costante raffronto tra norma e realtà, il volume mira ad integrare dialetticamente contributi che adottano punti di partenza differenti e complementari. L’obiettivo è lo sviluppo di un’indagine critica sull’assetto che l’intrecciarsi di una molteplicità di fattori conferisce infine ai bisogni individuali ed alle esigenze collettive che si confrontano quando la necessità di proteggere l’infanzia si traduce nell’esigenza di sottrarre al carcere donne in conflitto con la giustizia penale, il bisogno di cura s’affianca alle istanze di difesa sociale nella coesistenza fra reato e disturbo mentale, l’immigrazione diventa terreno di scontro fra aspirazioni securitarie e tutela dei diritti e delle libertà fondamentali della persona.

In Italia, la sottorappresentazione della popolazione femminile in ambito detentivo (la percentuale si attesta intorno al 4,5%) ha portato negli anni a una disattenzione nei confronti dei bisogni e dei diritti di questa “minoranza”, apparentemente non meritevole di interventi specifici in un contesto di carenza strutturale di risorse umane e finanziarie. Tale marginalità è inoltre la causa del generale disinteresse da parte della ricerca scientifica sociologica nei confronti dell’intero universo femminile dell’esecuzione penale, specialmente qualora questa si espleti all’esterno dell’istituzione penitenziaria. Il presente volume offre i risultati di una ricerca sociologica qualitativa sull’esecuzione penale di madri con figli minori nei territori delle province di Padova, Rovigo e Venezia. In particolare, si analizzano i processi di criminalizzazione che hanno investito le partecipanti (con riferimento soprattutto al sentencing giudiziario), le modalità e i vissuti relativi all’esecuzione penale esterna e in carcere (con interviste semi-strutturate alle donne interessate e alle operatrici coinvolte) e i vissuti e le esperienze di maternità situati all’interno di questa cornice penale.

Contemporary Research on crime, prisons, and social control has largely ignored women. Partial Justice, the only full-scale study of the origins and development of women's prisons in the United States, traces their evolution from the late eighteenth century to the present day. It shows that the character of penal treatment was involved in the very definition of womanhood for incarcerated women, a definition that varied by race and social class. Rafter traces the evolution of women's prisons, showing that it followed two markedly different models. Custodial institutions for women literally grew out of men's penitentiaries, starting from a separate room for women. Eventually women were housed in their own separate facilitiesâa development that ironically inaugurated a continuing history of inmate neglect. Then, later in the nineteenth century, women convicted of milder offenses, such as morals charges, were placed into a new kind of institution. The reformatory was a result of middle-class reform movements, and it attempted to rehabilitate to a degree unknown in men's prisons. Tracing regional and racial variations in these two branches of institutions over time, Rafter finds that the criminal justice system has historically meted out partial justice to female inmates. Women have benefited in neither case. Partial Justice draws in first-hand accounts, legislative documents, reports by investigatory commissions, and most importantly, the records of over 4,600 female prisoners taken from the original registers of five institutions. This second edition includes two new chapters that bring the story into the present day and discusses measures now being used to challenge the partial justice women have historically experienced.
