Com o sugestivo título “Da Máquina à Nuvem - Caminhos para o acesso à justiça pela via de direitos dos motoristas da Uber”, a obra retrata o resultado de pesquisa, densa e profunda, sobre o trabalho das pessoas que se encontram vinculadas às relações jurídicas estabelecidas no transporte contratado por meio do aplicativo multiplataforma – ou simplesmente “app” – Uber. Em uma interessante metáfora com o veículo, alguns dos seus componentes ou relacionados ao ato de dirigir, a jovem pesquisadora distribui o tema em quatro capítulos (“o veículo”, “o motor”, “a sinalização” e “a direção”), além da conclusão. No primeiro deles, aborda a origem da empresa Uber, as agressivas estratégias de marketing adotadas para que se tornasse conhecida mundialmente e disseminasse a forma de contratação do serviço de transporte por ela introduzida, na qual o motorista trata o passageiro de modo particularmente diferenciado a ponto de parecer a ele que esteja utilizando o serviço de um verdadeiro “motorista particular”, e não um serviço comum de transporte. O segundo capítulo é um dos mais importantes. Dedica-se ao capitalismo, desde o surgimento da máquina a vapor – “a máquina” – até o capitalismo cognitivo – “ a nuvem” –, este último referenciado como o “motor” da “uberização da economia”, neologismo que caracteriza uma das facetas do capitalismo contemporâneo, provocador de novas formas de exploração do trabalho humano, as quais, paradoxalmente, recuperam velhas estratégias de dominação e as tornam cada vez mais refinadas, ao se apropriarem das qualidades da emoção do trabalhador para torná-lo devedor de sua autorrealização, concretizada pelo aumento do dever de trabalhar, e terminam por atingir o acesso à Justiça, ao qualificá-lo – e ele acreditar nisso – em “microempresário-parceiro”. A obra é ainda mais completa porque não deixou de lado os marcos centrais da sociedade contemporânea – a sociedade do controle –, cada vez mais planificada, em que tudo é visto e tudo é controlado, graças aos avanços da era digital, com chips cada vez mais potentes e diminutos, difusão de redes sociais, transmissão dos acontecimentos em tempo real. Enfim, é uma obra de destaque, própria daqueles que reconhecem a importância do Direito na construção de uma sociedade que, nos termos da Constituição de 1988, deve caminhar na direção de tornar-se cada vez mais justa, fraterna e solidária, e o trabalho humano não seja mera moeda de troca no “jogo” do mercado – nem sempre fraterno, nem sempre justo e nem sempre solidário –, mercado esse que, diga-se de passagem, se tornou um ser quase real, sempre a mudar de “temperamento” e se mostrar por vezes “sensível”, “irritado” ou “oscilante”, capaz de determinar o comportamento das pessoas, especialmente em tempos como os atuais, nos quais o Direito do Trabalho se torna alvo predileto de transformações marcadas por claros retrocessos sociais.
