People with disabilities form one of the major groups of recipients of social security benefits. The basis of this study has been to explore people's experiences and attitudes towards the process of claiming disability benefits. A qualitative rather than quantitative research approach has been used to investigate possible difficulties with the benefit claim process and the factors influencing take-up of disability benefits.

If you are applying for disability insurance benefits in Canada, there is a good chance the insurance company will deny your claim, or stop payment of benefits, even if you are truthful and legitimately disabled. The insurance company's decision to approve or deny your claim is not based on the truth as you know it; rather, it is based on the information in their claim file. If the seriousness of your disability is not accurately explained in the claim file, then your claim will get denied. The key to winning disability benefits is to prepare a comprehensive application for disability benefits, which tells your full story and shows the seriousness of your disability. If you are like most people, your application will only include the bare minimum claim forms, and this will almost guarantee a denial of disability payments. With A Beginner's Guide To Disability Insurance Claims in Canada, you will learn the exact process top disability benefit lawyers use to prepare comprehensive applications and appeals.

Are you thinking about filing for Social Security Disability but don't know where to start? Most disability claimants start the process without knowing that there are very important steps they should take before filing a claim. From talking to medical providers about disability to gathering medical evidence to making that phone call, claimants must understand the "big picture" of a disability claim, otherwise they risk going through years of hardship waiting for a disability award that may never come; all because they filed their claim without the right tools from the start. Real Tactics for Filing Your Social Security Disability Claim is a tactical guide where you will learn the 'ins and outs' of preparing and filing a disability claim, just like the pros, to increase your chances of winning your claim. This guide was written for the non-legally trained claimant in language that requires no translation by a lawyer. That's right! No attorney 'gibberish' or 'snooze-fest' terms. The tactics here are written in plain English that anyone can understand and follow. Readers will also be able to join an exclusive Facebook page where they can ask questions about the lessons and materials so that no stone is left unturned.

Here's how YOU can avoid the mistakes that cause many disability claims to be wrongly denied. Did you know that more than half of those who apply for Social Security or SSI disability and receive a medical decision are eventually APPROVED? However, it is also true that only about 35% of people filing for benefits are approved the first time they apply. This means that many cases are denied the first time and then approved after filing an appeal. Why are so many claims denied the first time? In many cases, the initial application is just not filled out correctly. No matter how severe your medical problems are, if you don't explain them well enough and provide the right information when you apply, your claim can be denied. As a former Social Security Claims Representative who recently retired after 25 years of handling disability claims, the author of this book can offer you the benefit of his experience by walking you step-by-step through the application process. In this simple, easy to follow, no-nonsense guide, Charles Richfield focuses on what you really need to know as a claimant for disability. He does not waste your time with useless information about the history of Social Security, and does his best not to confuse you with unnecessary details about rules, regulations and exceptions that don't apply to most people applying for benefits; this is NOT a training manual! You will learn and understand: -The basic types of disability benefits and how to qualify for them -How the medical decision is made -How to decide if you need a lawyer -What you need to do even BEFORE you file the application -How to go about filing your own application without even coming into an office -What you need to know about applying in person or by phone -What you need to do while your application is waiting for a medical decision -What to expect if your application is approved -The best ways to file effective appeal requests that will maximize your chances of being approved In addition, the author has included a Special Bonus Section near the end of the book which not only gives you expert advice about filling out the medical and work history sections of the Adult Disability Report; it also explains how you can find out EXACTLY what kinds of medical records and test results the examiner will be looking for according to the type of illness or injury you have. That information alone could help you provide the examiner with the proof needed to approve your claim! If you or someone you know is unable to work because of injury or illness, don't wait! You can lose hundreds, maybe thousands of dollars in disability benefits if you wait too long to apply-it happens to other people much too often. File that application as soon as you can, but also make sure you fill it out THE RIGHT WAY from the start! This book will help you to do just that.

The Social Security Administration (SSA) provides Social Security Disability Insurance (SSDI) benefits to disabled persons of less than full retirement age and to their dependents. SSA also provides Supplemental Security Income (SSI) payments to disabled persons who are under age 65. For both programs, disability is defined as a "medically determinable physical or mental impairment" that prevents an individual from engaging in any substantial gainful activity and is expected to last at least 12 months or result in death. Assuming that an applicant meets the nonmedical requirements for eligibility (e.g., quarters of covered employment for SSDI; income and asset limits for SSI), the file is sent to the Disability Determination Services (DDS) agency operated by the state in which he or she lives for a determination of medical eligibility. SSA reimburses the states for the full costs of the DDSs. The DDSs apply a sequential decision process specified by SSA to make an initial decision whether a claim should be allowed or denied. If the claim is denied, the decision can be appealed through several levels of administrative and judicial review. On average, the DDSs allow 37 percent of the claims they adjudicate through the five-step process. A third of those denied decide to appeal, and three-quarters of the appeals result in allowances. Nearly 30 percent of the allowances made each year are made during the appeals process after an initial denial. In 2003, the Commissioner of Social Security announced her intent to develop a "new approach" to disability determination. In late 2004, SSA asked the Institute of Medicine (IOM) to help in two areas related to its initiatives to improve the disability decision process: 1) Improvements in the criteria for determining the severity of impairments, and 2) Improvements in the use of medical expertise in the disability decision process. This interim report provides preliminary recommendations addressing the three tasks that relate to medical expertise issues, with a special focus on the appropriate qualifications of medical and psychological experts involved in disability decision making. After further information gathering and analyses of the effectiveness of the disability decision process in identifying those who qualify for benefits and those who do not, the committee may refine its recommendations concerning medical and psychological expertise in the final report. The final report will address a number of issues with potential implications for the qualifications of the medical experts involved in the disability decision process.
