Referendums have become an undeniably important, and perhaps inescapable, peacemaking tool in contemporary peace processes. As such, understanding the ways in which referendum outcomes are shaped by peace negotiations is vital. Drawing upon two case studies, Amaral presents an empirically rich comparative analysis of the Annan Plan in Cyprus and the Good Friday Agreement in Northern Ireland. She examines the negotiations, offering new interview material with key political and civil figures involved in the peace negotiations and referendum campaigns in both cases. Amaral argues that referendums are unsuitable for traditional secretive and exclusionist peace negotiations that fail to engage and educate the public. They rather require inclusive negotiations that involve a broad spectrum of political stakeholders and civil society at the early stages of the process. This peacemaking approach can allow referendums to positively shape societies in conflict and be a crucial step toward lasting peace.

Since 1990, peacemakers have mandated and held a growing number of referendums in efforts to address the causes of potential or actual armed conflicts. These "peacemaking referendums" are a peacemaking tool that is increasingly used but little understood. Peacemaking referendums have the potential to advance peace and settle conflicts for cases in which neither war nor negotiation alone could bring a conflict to conclusion. By addressing and transforming sovereign state configurations at the heart of conflict, a referendum may redraw boundaries, reshape structures of governance, and provide inclusion and protection for minorities. In so doing, peacemaking referendums can make unique and positive contributions to ending conflict. However, referendums held in the context of conflict, posing existential questions to divided societies may be dangerous due to their zero-sum, high-stakes, majoritarian characteristics. This dissertation aims to explore under what circumstances peacemaking referendums lead to violence, conflict or stable peace. The research offers a conceptual model for understanding the potential risks and contributions of peacemaking referendums. Thirteen case studies were developed, including field work and elite interviews in South Sudan, Cyprus, East Timor, and Indonesia. The ten additional cases were developed as structured case studies. Drawing from these cases, the dissertation inductively builds a typology of peacemaking referendums, in which four types of referendums are distinguished based on (a) whether the referendum is part of a negotiation process and (b) whether the referendum is designed to finally conclude the conflict. Within each type, a distinct process links the cases into a coherent set with particular risks and contributions. The typology and case studies generate a series of hypotheses that link peace negotiations to referendums' structures, results, and outcomes. The research contributes to literature on direct democracy, the use of elections in post-conflict transitions, peacemaking and negotiation, and the use of conflict management strategies such as territorial partition and power-sharing. It could also serve as a conceptual lens through which practitioners and scholars view the use of referendums for peacemaking and peacebuilding.

It offers an alternative theory of referendums whereby they are one of many ordinary ways that voters give direction to their representatives. In this way, the book argues that referendums are better understood as exercises in representative democracy. The book challenges the current treatment of referendums in processes of constitutional change both in the UK and around the world. It argues that referendums have been used under the banner of popular sovereignty in a way that undermines representative institutions. This book makes the case for the use of referendums stronger by showing how they can support, rather than undermine, institutions of representative democracy. Understanding referendums as exercises in representative democracy has broader implications for constitutional democracy as well. Rather than see the power to constitute constitutions as something that happens occasionally in exceptional moments through referendums, this book argues instead that voters constantly have the power to constitute and reconstitute their constitutions.

The possibility of democracy-enhancing uses and anti-democratic abuses of referendums reveals a paradox: mechanisms of democracy can be exploited to do violence to the basic principles of democracy. The Limits and Legitimacy of Referendums seeks to identify standards we might use to assess the democratic legitimacy of a referendum when we cannot rely on the norms of traditional liberal democracy. This innovative book explores how referendums manage the tension between liberalism and democracy, and whether this device holds promise for reconciling these two commitments.
