Patent law, created in response to a constitutional mandate to en-courage innovation, may be discouraging important forms of cooperative innovation. Advances in technology have enabled new ways of pooling knowledge and computational capabilities, facilitating cooperation among many participants with complementary skills and motivations to collectively solve complex problems. But emerging models of cooperative innovation increasingly run into patent roadblocks. Why might patent law sometimes thwart instead of support socially beneficial cooperative innovation? The problem lies in the tensions between the market-based incentives that patent law creates and the mechanisms that support emerging models of cooperative innovation. The complexity and cost of solving contemporary public challenges are nudging diverse participants together to collectively build their knowledge, but patents often serve to keep them apart. While digital technologies enable new forms of massively distributed, open and collaborative intellectual production, patents threaten the vitality and even the viability of these promising types of innovation. In this Article I use two examples - the risk of crowding out crowd science and the battle between proprietary software companies and free open source software platforms, to illustrate how patent law in its current form may sometimes impede beneficial cooperation in innovation. I then suggest how we might limit the negative effects of patents in contexts of cooperative innovation without undermining the patent system.

th The 11 Working Conference of IFIP WG 8.6, Open-IT Based Innovation: Moving Towards Cooperative IT Transfer and Knowledge Diffusion, organized in Madrid in October 22–24, 2008, follows the series started in Oslo in 1995 and continues in the footprints of the past year’s conference in Manchester. This year, although the Madrid Conference addresses the usual topics covered in previous WG8.6 conferences, the emphasis is on the issue of open innovation and its relationships with technology transfer and diffusion in the field of information technology. This issue is deeply modifying the way that knowledge is generated, shared, transferred, diffused, and used across the world as a side effect of globalization. It affects the organizational structure, partnerships, roles assumed by stakeholders, and technology transfer and diffusion models and instruments. Industry, academia, and governments are simultaneously concerned. Although the concept applies to all industrial sectors, IT companies were early innovators. The analysis of the contents of this book allows the identification of some trends in technology transfer and diffusion issues as a part of the innovation process. The same problem is addressed in very different ways and extrapolation is not straightforward. Even innovation terminology is not clearly shared by different subcultures in the field.

The Oxford Handbook of Mutuals and Co-Owned Business investigates all types of 'member owned' organizations, whether consumer co-operatives, agricultural and producer co-operatives, worker co-operatives, mutual building societies, friendly societies, credit unions, solidarity organizations, mutual insurance companies, or employee-owned companies. Such organizations can be owned by their consumers, the producers, or the employees - whether through single-stakeholder or multi-stakeholder ownership. This complex set of organizations is named differently across countries: from 'mutual' in the UK, to 'solidarity cooperatives' in Latin America. In some countries, such organizations are not even officially recognized and thus lack a specific denomination. For the sake of clarity, this Handbook will refer to member-owned organizations to encompass the variety of non-investor-owned organizations, and in the national case study chapters the terms used will be those most widely employed in that country. These alternative corporate forms have emerged in a variety of economic sectors in almost all advanced economies since the time of the industrial revolution and the development of capitalism, through the subsequent creation and dominance of the limited liability company. Until recently, these organizations were generally regarded as a rather marginal component of the economy.
