Tentative estimates suggest that one in ten patients suffers from an adverse event in hospital. In Germany, approx. 1.8 million out of approx. 18 million inpatients suffer from adverse events; 50 percent of these cases are estimated to be avoidable. In the US, nearly 100,000 people die from the consequences of mistreatment. The intensive care units record 1.7 medical errors per patient and day. The most affected disciplines are the operative disciplines, particularly general surgery. Medical errors mainly occur when the indication for surgery is being made, during surgery and post-surgery. Suspicious oncological diagnostic results and post-operative complications are also often ignored. This book deals with complications and typical medical errors in surgery. It shows solutions and ways of dealing effectively with these errors and how to establish an efficient security management system.

Excerpt from Civil Malpractice: A Treatise on Surgical Jurisprudence; With Chapters on Skill in Diagnosis and Treatment, Prognosis in Fractures, and on Negligence The very favorable reception of a Report on Civil Malpractice, made to the Military Tract Medical Society in 1873, encouraged me to continue collecting material for a more extended work on the same subject, should it ever be called for. From the increasing frequency of suits, for alleged negligence and want of skill on the part of physicians, especially in the West, it seems that such a compilation is now needed. Originality is claimed only for the selection and arrangement of the material. The work, I trust, will be a useful one, inasmuch as the Supreme Court decisions, upon this feature of the doctrine of Bailments, scattered as they are through numerous state Reports, are inaccessible to most legal and medical practitioners. These decisions I have collected and grouped according to their medical rather than their legal interconnection. By aid of the index, however, the legal principles may be readily referred to. Some of the decisions I have introduced by an abstract of the evidence presented at the first trial. There will also be found the history and abstract of evidence in numerous other cases, not taken to appellate courts, many of which have not been, heretofore, so published as to be accessible to either the medical or legal professions. Books such as this one are deceptively difficult to create. The general subject is neither happy, nor easy, nor most anyone’s idea of fun. M- practice litigation, however, has become a central fact of existence in the practice of medicine today. This tsunami of lawsuits has led to a high volume of irreconcilable rhetoric and ultimately threatens the stability of the entire health care system. Our goal has been to provide a source of reliable information on a subject of importance to all who provide me- cal care in the United States. The book is divided into four sections. Part I gives an overview of insurance in general and discusses the organization of professional - ability insurance companies in particular. Part II focuses on the litigation process itself with views from the defense and plaintiff bar, and the physician as both expert and defendant. Part III looks at malpractice litigation from the viewpoint of the practicing physician. Some of the chapters are broadly relevant to all doctors—the rise of e-medicine, and the importance of effective communication, for example. The other ch- ters are constructed around individual medical specialties, but discuss issues that are of potential interest to all. Part IV looks ahead. “The Case for Legal Reform” presents changes in medical-legal jurisprudence that can be of immediate benefit. The final two chapters take a broader perspective on aspects of our entire health care system and its interface with law and public policy.
