This book explores the European Public Prosecutor’s Office (EPPO), the creation of which was approved in the Regulation adopted by the Justice and Home Affairs (JHA) Council on 12 October 2017. The EPPO will be an independent European prosecution office tasked with investigating and prosecuting those crimes defined in the recently adopted Regulation 2017/1371 on combating fraud against the Union’s financial interests by means of criminal law. As such, it will be a new actor on the EU landscape, governed by the principle of loyal cooperation with the national prosecuting authorities. This work clarifies some of the challenges that member states will have to face when dealing with a supranational prosecution authority. In addition, it provides guidelines on how to implement the present Regulation while respecting the fundamental rights of defendants in criminal proceedings. The book is of special interest in so far as the analysis and perspective of academics is completed with the contributions of legal experts who have either been involved in the negotiations to establish the European public prosecutor or will be closely linked, as public prosecutors, to the functioning of the future European public prosecutor’s office.

In 2013 the European Commission launched its legislative proposal to create a European Public Prosecutor’s Office. The proposal provoked fierce debates, politically as well as on the academic level. Many national parliaments opposed and submitted formally their grievances to the Commission. Negotiations on the proposal between Member States are still ongoing. The T.M.C. Asser Instituut held the first international conference on this unprecedented proposal. This book reflects the main results of that conference. This report presents proposals for the restructuring and streamlining of the processing of criminal cases at state and local levels. A major restructuring and streamlining of procedures and practices in processing criminal cases at state and local levels is proposed by the National Advisory Commission on Criminal Justice Standards and Goals. The proposals of the Commission appear in the form of specific standards and recommendations -- almost 100 in all -- that spell out in detail where, why, how, and what improvements can and should be made in the judicial segment of the criminal justice system. The report on courts is a reference work for the practitioner -- judge, court administrator, prosecutor, or defender -- as well as the interested layman. The Commission argues that the problems which keep the criminal court system from performing its functions are inconsistency in the processing of criminal defendants, uncertainty concerning results obtained, unacceptable delays, and alienation of the community. In composing suggested improvements for the court system, the Commission's first priority is to devise standards for attaining speed and efficiency in the pretrial and trial processes and prompt finality in appellate proceedings. The second priority is the upgrading of defense and prosecution functions and the third priority is the assurance of a high quality in the judiciary. To expedite pretrial procedures the prosecutor should screen all criminal cases coming before him and divert from the system all cases wherein further processing by the prosecutor is not appropriate. Among Commission recommendations are: elimination of all but the investigative function of the grand jury; elimination of formal arraignment; unification of all courts within each state; and the upgrading of criminal court personnel.

Prescriptive package designed to assist police managers to improve the success of their departments' criminal investigation efforts. While skilled detectives are often essential, there are a number of new methods police managers can adopt to improve investigative success. Management issues addressed include budgeting and allocating resources; improving relationships with the prosecutor; interacting with the public, especially victims and witnesses; improving relationships between investigators and patrol officers; decentralizing detective assignments, particularly in neighborhood team policing approaches; using civilian employees for investigative tasks; assigning personnel; supervising and training investigative personnel; improving investigative procedures; and conducting investigative activities not related to specific cases. The suggestions are based on an examination of the investigative practices of six selected police departments, a review of the relevant literature and recent experiments in other departments, and the observations and conclusions of a panel of experienced police officials. It is especially interesting to note that many of the ideas require little or no additional resources. This report is written primarily for police chiefs and heads of detective units, but should also be of interest to other police officials and to local government officials such as city managers.
