Los estudios reunidos en este volumen, que comprenden todas las divisiones sistemáticas del Derecho civil además del Derecho interregional, se realizaron con ocasión de la conmemoración del cincuentenario (2010) de la Compilación del Derecho civil de Cataluña (1960) y proponen tanto un análisis crítico de la actividad legislativa hasta ahora llevada a cabo como una prospección de la labor pendiente en orden a la codificación de la materia civil. Una obra, sin duda, de obligada referencia para quien, a partir de ahora, quiera adentrarse o profundizar en el Derecho civil catalán. Completadas por el Parlamento de Cataluña las primeras fases del ejercicio de la competencia exclusiva para conservar, modificar y desarrollar su Derecho civil, la promulgación de la Ley 29/2002, de 30 de diciembre, Primera ley del Código Civil de Cataluña inició un proceso legislativo que, teniendo por objetivo la consecución de un texto sistemático y con vocación omnicomprensiva, superara las insuficiencias propias de las técnicas hasta entonces empleadas, constituidas, en una primera fase, por la adopción de la Compilación (1984), en una segunda, por la actualización mediante leyes especiales de un Derecho en buena parte anacrónico y, en una tercera, por la codificación sectorial del Derecho de sucesiones (1991) y del Derecho de familia (1998). A pesar de que la obra legislativa civil catalana, en su conjunto, ha merecido el reconocimiento general, su diversificación formal y su contenido fragmentario reclamaban, ya en el siglo xxi, su codificación. El Código Civil de Cataluña es hoy una realidad vigente en cinco de sus seis libros proyectados, a la espera de ser completada, en un futuro próximo, con el Libro sexto, relativo a las obligaciones y los contratos.
