A liberdade religiosa (de forma ampla) constitui um dos direitos fundamentais protegidos pelo arcabouço constitucional pátrio, em consonância com diversos Tratados Internacionais. Nesta obra é analisada a liberdade religiosa, sua origem, evolução histórica e suas implicações atuais no campo da educação, nas organizações dos vestibulares e dos concursos públicos, especialmente focados nos casos de possibilidade de apresentação por parte dos cidadãos da negativa de consciência e crença, prevista no art. 5º, inciso VIII, da Constituição de 1988, em virtude de haver uma lacuna jurídica pela não regulamentação da matéria, como previsto na Carta Magna. A obra ainda busca estudar e analisar as principais ideias e pensamentos doutrinários sobre essa matéria e a linha de ação e resultado praticada pelo Judiciário brasileiro como resposta às inúmeras lides que se processam sobre essa questão, que é ampla, polêmica e que está longe de chegar ao desfecho, dadas a multiplicidade de problemas e a falta de regulação de preceitos constitucionais que perduram no Brasil. Para isso, são analisadas as principais jurisprudências sobre a matéria já julgadas no STF, STJ e em outros Tribunais (Federais e Estaduais), aliadas às análises das conclusões das principais correntes doutrinárias que tratam do tema, tratando-as de maneira crítica para buscar oferecer um entendimento novo e que atenda às demandas mais atuais. Também é tratada na obra a forma com que as instituições e organizações abordam o assunto, ainda que de maneira paliativa, pois a principal necessidade é a de total regulamentação da matéria, e quais as medidas foram e podem ser tomadas em casos de negativa de consciência por crença, também aplicáveis à objeção filosófica, mesmo nos casos de falta de regulamentação do dispositivo constitucional.
