La obra es un Manual de la asignatura “Derecho Eclesiástico del Estado”. Este Manual está adaptado a la metodología exigida por el denominado “Plan Bolonia” (Espacio Europeo de Educación Superior). El Manual se divide en dos grandes partes (Teoría General del Derecho Eclesiástico del Estado –concepto, modelos de relación Estado-confesiones religiosas, Derecho comparado, etc.— y, Derecho Eclesiástico del Estado español). Este Manual responde a la configuración del Derecho Eclesiástico del Estado como Derecho de la libertad de conciencia (que incluye la libertad religiosa): el estudio completo de esta libertad fundamental constituye el contenido de esta obra. La libertad de conciencia (religiosa o no) y todos los derechos y libertades fundamentales conexos con la misma son la esencia de cualquier sistema democrático. Las sociedades actuales se caracterizan por ser más plurales en el ámbito ideológico, cultural y religioso y, al tiempo, están más interconectadas entre sí. Estas circunstancias provocan que se produzcan, cada vez, más conflictos jurídicos a los que hay que dar respuesta. Este Manual nace, precisamente, con la pretensión de que todo alumno del Grado en Derecho conozca las respuestas que desde la perspectiva del Derecho Eclesiástico del Estado se pueden ofrecer a dichos conflictos jurídicos. El estudio de esta disciplina jurídica se ha imprescindible para que los alumnos tengan una formación jurídica completa y versátil.

El lector que se acerque a este Manual de Derecho Eclesiástico encontrará una amplia gama de temas en los que se despliega la dimensión jurídica de la religión: los cauces de relación con el Estado, las garantías de la profesión en libertad, la enseñanza, el matrimonio, los medios de comunicación, etc. El origen de esas regulaciones sectoriales donde el ámbito religioso tiene un tratamiento singular es, o debe ser, el derecho de libertad religiosa, tal y como se proclama en nuestra Constitución. Aun siendo cierta tal afirmación, tampoco hay que olvidar que nuestro pasado histórico y la posición de fuerza de la Iglesia católica han condicionado la utilización de instrumentos de relación, o la continuidad de situaciones ventajosas para aquella, que cristalizan en pautas e instituciones del pasado. El conjunto normativo que deriva de esta realidad no puede ocultar ciertas contradicciones respecto a la fuente constitucional.
