Firmar un contrato de trabajo es cada día más complicado. Las cifras del paro se han disparado y parece que en un futuro cercano la situación no mejorará demasiado. Aunque no hay soluciones sencillas al problema del desempleo, es posible que si se recuperan alternativas que en un principio se habían descartado, las oportunidades de encontrar trabajo aumenten. Se han reducido mucho y las plazas que salen hoy son muy limitadas, pero las hay. Quien se presente a una oposición debe estudiar durante bastante tiempo si quiere tener posibilidades de obtener un puesto de trabajo, más ahora que la competencia es mucho más dura. Sin embargo, para los concursos solo es necesario presentar méritos laborales y académicos anteriores y, en ocasiones, pasar una entrevista. Conviene, por tanto, consultar de manera periódica las páginas web de la Administración donde se publican cada semana las vacantes para empleos públicos. También es recomendable apuntarse a boletines en los que se informa de forma puntual sobre la oferta pública de empleo. La mayoría de las vacantes de los concursos son ahora para cubrir bajas por maternidad, por enfermedad o contratos de relevo para jubilaciones anticipadas. Se debe tener toda la documentación preparada, como los títulos académicos, los cursos realizados y la vida laboral actualizada, para el momento en el que se convoque una plaza. También se valoran los certificados de funciones de las empresas para cotejar si coinciden con las que se llevarán a cabo en el nuevo puesto de trabajo. Como los plazos para presentar los expedientes son reducidos, se debe tener todo disponible. Ante el actual panorama laboral, ser funcionario se ha convertido en la meta de muchos. Puesto fijo, bien remunerado, 35 horas semanales, jornada continua, pagas extraordinarias, posibilidades de ascenso en una empresa a pleno rendimiento. No se trata de un anuncio de trabajo al uso, sino de algunas ventajas de las tan codiciadas plazas de funcionario, que año tras año se disputan cientos de miles de aspirantes. Para acceder a una de ellas hay que superar un duro obstáculo: las temidas oposiciones, que habrán de prepararse como mínimo durante un año, asumiendo la posibilidad de no lograr plaza. La vida del opositor se ve notablemente alterada por la preparación de las pruebas. se pueden superar oposiciones para puestos como subalternos, auxiliares administrativos o administrativos estudiando entre nueve meses y un año. “Las oposiciones del grupo A (dirigidas a personas con título de doctor, licenciado, ingeniero, arquitecto o equivalente) requieren unos dos años de preparación. No obstante, hay aspirantes que aprueban en un tiempo inferior y otros que lo consiguen en siguientes convocatorias”. Además, una vez aprobada la oposición, hay trámites que seguir y no siempre se logra un puesto de forma inmediata. La documentación se debe presentar dentro de un plazo, después se solicitará el destino. El número uno de la convocatoria, el que mayor puntuación haya logrado en la oposición, podrá elegir entre todos los destinos, pero al último le corresponderá la última plaza en el destino que haya quedado vacante. Aquellos opositores que hayan aprobado los correspondientes exámenes pero no hayan conseguido plaza debido a la puntuación, pasarán a engrosar la bolsa de trabajo y serán ellos los primeros en ser convocados para cubrir vacantes temporales, bajas y cualquier otro tipo de necesidad que surja en el cuerpo al que han optado. Todas las oposiciones tienen en común temas de Organización del Estado (Constitución Española) y temas de Derecho Administrativo. El resto del temario variará en función del tipo de plaza a la que se opte y de la comunidad autónoma que saque las plazas. Las que exigen mayor preparación, dirigidas a titulados superiores, son las que menos competencia presentan pero también las más duras de preparar, tanto por la cantidad de la materia a estudiar como por su dificultad. Los programas pueden sufrir alguna modificación de una convocatoria a otra, pero lo habitual es que el conjunto de temas no cambie, con lo que la preparación realizada sirve para sucesivas convocatorias. Los procedimientos de selección incluyen pruebas diversas: ejercicios de temas de conocimientos generales o específicos (orales, escritos o ambos), test psicotécnicos, entrevistas, pruebas para valorar conocimientos de idiomas. Al menos uno de los ejercicios de la oposición ha de ser práctico. ¡Hola, opositores! Si tenéis claro que queréis dedicaros al sector sanitario, ¡esto os interesa! Antes de empezar a estudiar, es importante elegir bien la oposición a la que vais a presentaros. Pero, para eso, debéis conocer las posibilidades que existen. Lo primero que debéis saber es que cada comunidad autónoma convoca sus propias oposiciones de salud. De ahí la importancia de tener muy claro qué servicio de salud se corresponde con la comunidad autónoma en la que queréis opositar. Estudiar el temario de cada oposición es fundamental. Por ello, es indispensable conseguir la materia por la que se preguntará en las pruebas. Es habitual que si se acude a una academia para preparar los exámenes, en el centro entreguen todos los apuntes necesarios. En la propia convocatoria publicada en el BOE se especifica el temario de cada oposición. A menudo se editan manuales con los temas de los exámenes, pero en ocasiones, los opositores deben hacerse con los temas por su cuenta. Internet es una fuente muy importante de recursos. Algunas páginas web están especializadas en áreas concretas de oposición. En todas las Comunidades autónomas existen temas comunes. Para presentarse a las oposiciones es necesario cumplir unos requisitos. En ocasiones, se exige contar con una titulación específica o formación en un campo concreto. Otras veces, es necesario obtener ciertos certificados que acrediten el dominio de un área, como el uso de tecnologías de la información. Se puede estudiar en casa, consiguiendo el material por medios propios (a través de Internet o de algún conocido) o solicitando cursos a distancia. Estos últimos incluyen envío de material, tutorías (por correo, fax, teléfono o Internet), orientación y guía y ejercicios prácticos. La opción de preparar los exámenes en casa exige una organización ejemplar, adquirir hábitos de estudio, fuerza de voluntad a raudales y, sobre todo, disponer de medios para obtener la información necesaria (fechas, temarios, cambios).

Any contemporary state presents itself as committed to the “rule of law”, and this notion is perhaps the most powerful political ideal within the current global discourse on legal and political institutions. Despite being a contested concept, the rule of law is generally recognised as meaning that government is bound in all its actions by fixed and public rules, and that these rules respect certain formal requirements and are enforced by an independent judiciary. This book focuses on formal legality and the question of how to achieve good laws—a topic that was famously addressed by the 18th century enlightened thinkers, but also by prominent legal scholars of our time. Historically, the canon of “good legislation” demanded generality, publicity and accessibility, and comprehensibility of laws; non-retroactivity; consistency; the possibility of complying with legal obligations and prohibitions; stability; and congruency between enacted laws and their application. All these are valuable ideals that should not be abandoned in today’s legal systems, particularly in view of the silent revolution that is transforming our legality-based “states of law” into jurisdictional states. Such ideals are still worth pursuing for those who believe in representative democracy, in the rule of law and in the dignity of legislation. The idea for the book stemmed from the author’s parliamentary and governmental experience; he was responsible for the Government of Spain’s legislative co-ordination from 1982 to 1993, which were years of intensive legislative production. The more than five hundred laws (and thousands of decrees) elaborated in this period profoundly changed all sectors of the legal order inherited from Franco’s dictatorship, and laid the foundations of a new social and democratic system.
