L'Accordo ADR sul trasporto di merci pericolose è un accordo internazionale tra paesi dell’ONU (Organizzazione delle Nazioni Unite) la cui finalità è quella di armonizzare le norme di sicurezza attinenti i trasporti internazionali di merci su strada, nonché di garantire per tali trasporti un livello accettabile di sicurezza. ADR è l’acronimo di “Accord Dangereuses Routes”, sintesi di “Accord relatif au transport international des marchandises dangereuses par route“. L’Accordo è stato siglato a Ginevra il 30 settembre 1957 sotto gli auspici della Commissione Economica per l’Europa (ECE) ed è entrato in vigore il 29 gennaio 1968. I paesi che hanno sottoscritto l'ADR sono attualmente 54 (ultimo paese aderente Uzbekistan dal 24 Gennaio 2020); in Italia, per i trasporti nazionali è diventato obbligatorio con il D.M. 4 Settembre 1996 (abrogato dal D.Lgs del 27 Gennaio 2010 n. 35). L’obiettivo dell'Accordo ADR è di rendere il più sicuro possibile il trasporto di merci pericolose e contemporaneamente uniformare le norme del trasporto internazionale di merci pericolose su strada. Per il trasporto di rifiuti (pericolosi), identificati dal CER, che sono equiparati a soluzioni e miscele ADR, la difficoltà nella loro classificazione ONU come merci pericolose ai fini del trasporto ADR deriva dal fatto che i criteri che ne determinano la pericolosità sono concettualmente differenti in quanto devono essere incrociate le informazioni tra 2 differenti sistemi normativi: Direttive UE sui rifiuti e Accordo sul trasporto ADR dell'ONU. Per la norma ambientale nazionale sui rifiuti, il D.Lgs 152/2006 (recepimento Direttive UE), è prevalente il “rischio ambientale”, che privilegia azioni di messa in sicurezza e di bonifica, mentre secondo l’ADR (che è una norma sul trasporto ONU) la classificazione deriva dall'applicazione dei criteri ONU basati sul “pericolo effettivo”, e non si tiene conto della probabilità/esposizione prolungata. Il presente ebook, vuole fornire delle informazioni di base sull'Accordo ADR agli operatori del settore e della filiera dei rifiuti regolamentata da “Norme ambientali e Direttive UE", in quanto i rifiuti sono equiparati a soluzioni e miscele ADR, "Norma internazionale ONU". La struttura dell'ebook, con illustrazioni ed esempi pratici, può essere di significativo aiuto nel comprendere l'approccio alla classificazione di un rifiuto in materia ADR e la gestione delle attività di trasporto correlate con l'accordo ADR.
