This book examines how legal, political, and rights discourses, security policies and practices migrate and translate across the North Atlantic. The complex relationship between liberty and security has been fundamentally recast and contested in liberal democracies since the start of the 'global war on terror'. In addition to recognizing new agencies, political pressures, and new sensitivities to difference, it is important that not to over-state the novelty of the post-9/11 era: the war on terror simply made possible the intensification, expansion, or strengthening of policies already in existence, or simply enabled the shutting down of debate. Working from a common theoretical frame, if different disciplines, these chapters present policy-oriented analyses of the actual practices of security, policing, and law in the European Union and Canada. They focus on questions of risk and exception, state sovereignty and governance, liberty and rights, law and transparency, policing and security. In particular, the essays are concerned with charting how policies, practices, and ideas migrate between Canada, the EU and its member states. By taking ‘field’ approach to the study of security practices, the volume is not constrained by national case study or the solipsistic debates within subfields and bridges legal, political, and sociological analysis. It will be of much interest to students of critical security studies, sociology, law, global governance and IR in general. Mark B. This book investigates everyday practices of intelligence cooperation in anti-terrorism matters, with a specific focus on the relationship between Europe and Britain. In an effort to make sense of war beyond the battlefield in studying the wars that were captured under the rubric of the "War on Terror", this special issue book seeks to explore the complex spatial relationships between war and the spaces that one is not used to thinking of as the battlefield. It focuses on the conflicts that still animate the spaces and places where violence has been launched and that the war has not left untouched. In focusing on war beyond the battlefield, it is not that the battlefield as the place where war is waged has gone in smoke or has borne out of importance, it is rather the case that the battlefield has been dis-placed, re-designed, re-shaped and rethought through new spatializing practices of warfare. These new spaces of war – new in the sense that they are not traditionally thought of as spaces where war takes place or is brought to – are television screens, cellular phones and bandwidth, George W. Bush’s ranch in Crawford, Texas, videogames, popular culture sites, news media, blogs, and so on. These spaces of war beyond the battlefield are crucial to understanding what goes on the battlefield, in Iraq, Afghanistan, or in other fronts of the War on Terror (such as the homeland) – to understand how terror has globally been waged beyond the battlefield. This book is a case-study collection examining the influences and functions of British Columbia’s (BC) borders in the 21st century. British Columbia’s Borders in Globalization examines bordering processes and the causes and effects of borders in the Cascadian region, from the perspective of BC. The chapters cover diverse topics including historical border disputes and cannabis culture and identity; the governance of transboundary water flows, migration, and preclearance policies for goods and people; and the emerging issue of online communities. The case studies provide examples that highlight the simultaneous but contradictory trends regarding borders in BC: while boundaries and bordering processes at the external borders shift away from the territorial boundary lines, self-determination, local politics, and cultural identities re-inscribe internal boundaries and borders that are both virtual and real. Moreover, economic protectionism, racial discourses, and xenophobic narratives, driven by advances in technology, reinforce the territorial dimensions of borders. These case studies contribute to the literature challenging the notion that territorial borders are sufficient for understanding how borders function in BC; and in a few instances they illustrate the nuanced ways in which borders (or bordering processes) are becoming detached from territory. The chapters in this book were originally published as a special issue of the Journal of Borderlands Studies.

The book addresses the legality of indefinite detention in countries including Australia, the United Kingdom and Canada, enabling a rich cross-fertilisation of experiences and discourses. The issue has arisen where a government is frustrated in its ability to remove a non-citizen subject to a removal order and employs a power to detain him until removal. The cases raise fundamental questions about the nature and extent of immigration powers, the legal position of non-citizens and counter-terrorism law and policy. More broadly, the judgments have become key reference points in discussions of constitutionalism, rights and a range of contemporary issues in public law.The book analyses the legal context, reasoning and implications of the case law on indefinite detention. It argues that the law of each jurisdiction contains ample resources to support a ruling that indefinite detention is illegal. It demonstrates that, taking into account variations in legal frameworks and doctrines, a judge's response to indefinite detention is determined by his or her answer to the question whether a non-citizen, subject to a removal order, retains a right to liberty. It details how a judge's answer flows through his or her adjudication on the scope of the relevant exception to liberty.The thesis on which the book is based won the 2010 Marks Medal from the University of Toronto Law Faculty for the best graduate thesis.
