The marine environment does not naturally respect arbitrary international boundaries. The establishment and management of transboundary marine protected areas therefore presents major governance challenges. This book analyses a series of marine transboundary conservation initiatives embedded in varying contextual situations to examine the underlying reasons for their success or failure. Utilising an adapted ‘pathways of influence’ framework, it provides insights into the development of marine transboundary conservation initiatives looking at the effectiveness of international rules, international norms and discourse, market forces and direct access to policy making. Examples come from a wide range of jurisdictions, including territorial seas, continental shelves, exclusive economic zones and areas beyond national jurisdiction. Case studies include initiatives in the Coral Triangle, West Africa, Central America, the Wadden Sea, the Red Sea and the Mediterranean Sea. In addition the authors assess the potential for developing wider international cooperation as a result of relationships forged though involvement within these marine transboundary conservation initiatives.

This is a new edition of the classic textbook on marine protected area (MPA) management in the tropics, originally produced as an output of the Bali World Parks Congress in 1982. Approaches to planning and managing MPAs have evolved considerably. Major advances include innovative financing mechanisms, partnerships with the private sector and NGOs, and collaborative management between government and coastal communities. These advances have brought new approaches for MPA establishment and management that are more participatory, involving communities through interaction and collaboration rather than prescription. With new case studies and illustrations, the guide comes in a water-resistant cover for field use. It is intended for those who plan individual and/or national MPA systems and gives philosophical context for MPAs along with some basic principles and approaches.

Marine Conservation And International Law written by Sarah Louise Lothian and has been published by Taylor & Francis this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-07-22 with Law categories.

This book provides a blueprint for an International Legally Binding Instrument (ILBI) for the conservation and sustainable use of marine biodiversity beyond national jurisdiction (BBNJ). The development of an ILBI could signify a pivotal turning point in the law of the sea by addressing regulatory, governance and institutional gaps and deficiencies in the existing international law framework for BBNJ. This book analyses the essential components an ILBI will require to effectively conserve and sustainably use BBNJ, focusing on marine genetic resources, areabased management tools, environmental impact assessments, capacity-building and marine technology transfer. It investigates potential areas of compromise, as the success of an ILBI will rely upon the support of a powerful bloc of maritime States, principally the United States, the United Kingdom, Russia, the Netherlands, France and Japan. The participation of major maritime powers will be critical as it is their nationals, corporations and flag vessels that have the financial and technical wherewithal to undertake activities beyond national jurisdiction. This bloc of States has historically been the strongest proponent of the Grotian doctrine of ‘freedom of the seas’ as it aligns with their predominant interest to preserve navigational freedom for their merchant and military fleets. Accordingly, this book assesses the extent to which the Grotian doctrine continues to exert influence on the development of the law of the sea and the development of an ILBI. Providing a comprehensive overview of this important development in international law, this book will be of interest to students, lecturers and academics of law of the sea, international environmental law and biodiversity law.

The objective of this book is to provide a comprehensive overview of the legal basis, under international law and the relevant regional legal frameworks, for the establishment and further development of area-based conservation tools in the Mediterranean Sea, with a particular emphasis placed on the transboundary area-based conservation instruments available for the Adriatic and Ionian Seas. Specifically, the aim is to identify and analyze the concepts and functioning of both marine protected areas (MPAs), as traditional area-based tools enabling marine habitat and species conservation, and other effective area-based conservation measures (OECMs), as a more recent addition to the picture. Further, with a view to providing responses to the complex set of challenges raised by the variety of tools and levels of intervention, conclusions and ways forward are provided that identify practical implementation instruments through which a truly transboundary perspective may guide the development of protected marine spaces in the macro-region. An essential consideration in defining the ways forward lies in that the current trend towards the establishment of exclusive economic zones could soon become an incentive towards the adoption of a coherent and coordinated Mediterranean – and Adriatic and Ionian – network of transboundary area-based conservation tools. The book will be of interest to policy makers, practitioners, and academics with an interest in public international law, the law of the sea, and sustainable ocean governance.

Marine Biodiversity Conservation written by Keith Hiscock and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-08-21 with Nature categories.

Effective marine biodiversity conservation is dependent upon a clear scientific rationale for practical interventions. This book is intended to provide knowledge and tools for marine conservation practitioners and to identify issues and mechanisms for upper-level undergraduate and Masters students. It also provides sound guidance for marine biology field course work and professionals. The main focus is on benthic species living on or in the seabed and immediately above, rather than on commercial fisheries or highly mobile vertebrates. Such species, including algae and invertebrates, are fundamental to a stable and sustainable marine ecosystem. The book is a practical guide based on a clear exposition of the principles of marine ecology and species biology to demonstrate how marine conservation issues and mechanisms have been tackled worldwide and especially the criteria, structures and decision trees that practitioners and managers will find useful. Well illustrated with conceptual diagrams and flow charts, the book includes case study examples from both temperate and tropical marine environments.

International Law And Marine Areas Beyond National Jurisdiction written by Vito De Lucia and has been published by BRILL this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-01-31 with Law categories.

The legal regime of marine areas beyond national jurisdiction (ABNJ) has received much attention in the last decades. The ongoing process in regards of an agreement on the conservation and sustainable use of marine biodiversity in ABNJ, initiated in the early 2000s (BBNJ process) is crucial evidence of this. However, this process reflects entrenched interests and political and legal structures, muting other voices and alternative approaches. International Law and Marine Areas beyond National Jurisdiction investigates competing constructions of ABNJ and their role in the creation and articulations of legal principles, which provides a broader perspective on the BBNJ process.

The once pristine and rich marine environment of the South China Sea is degrading at an alarming rate due to the rapid socioeconomic development of the region. Despite this, and due mainly to complicated sovereignty and maritime disputes, coastal States have not been able to develop effective regional cooperation to safeguard the shared marine environment. Marine Protected Areas Network in the South China Sea discusses legal and political measures to support the development of a network of marine protected areas in the South China Sea. Such a network, if properly developed, would not only help to protect the marine environment and resources of the region but also contribute to decreasing the tension among its coastal States. These measures are suggested in accordance with international law, based on the specific geopolitical context of the South China Sea region and take into consideration experiences in developing regional networks of marine protected areas from other marine regions.
