Secara umum, tindak pidana cyber terrorism adalah kejahatan yang memanfaatkan teknologi informasi. Hal demikian dapat dialami oleh masyarakat sipil yang memakai Internet sebagai media komunikasi, dapat juga dialami oleh kalangan bisnis asing atau lokal, dan lembaga pemerintahan. hal ini tentunya merupakan ancaman serius, sehingga diharapkan ada suatu perangkat hukum yang dapat mengatasi kejahatan cyber terrorism. Undang-Undang Nomor 15 Tahun 2003 Tentang Pemberantasan Terorisme dan Undang-Undang ITE Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik merupakan prangkat hukum yang memadai saat ini untuk memberantas aksi cyber terrorism. Dalam undang-undang ini disebutkan pula unsur-unsur yang terdapat dalam tindak pidana cyber terrorism beserta pembuktian secara elektronik sebagai alat bukti yang sah dalam menangani aksi ini.

Social Control Through Law is remarkable in manner and style. Roscoe Pound shows himself to be a jurist, philosopher, and scientist. For Pound, the subject matter of law involves examining manifestations of human nature which require social control to assert or realize individual expectations. Pound formulates a list of social-ethical principles, with a three-fold purpose. First, they are meant to identify and explain human claims, demands, or interests of a given social order. Second, they express what the majority of individuals in a given society want the law to do. Third, they are meant to guide the courts in applying the law. Pound distinguishes between individual interests, public interests, and social interests. He warns that these three types of interests are overlapping and interdependent and that most claims, demands, and desires can be placed in all three categories. Selanjutnya dinyatakan bahwa Pengadilan HAM yang dibentuk berada di lingkungan Peradilan Umum (ayat (3)). Adapun dalam Pasal 44 dinyatakan bahwa pemeriksaan di Pengadilan HAM Ad Hoc dan upaya hukumnya dilakukan sesuai dengan ketentuan dalam undang-undang ini (UU No. 26 Tahun 2000).
