It also provides the reader with a wealth of detail about the ideas and values that underlie tort 'doctrine'-tort law's rules and principles, and the way those rules and principles operate in practice. The book is an accessible introduction to tort law that will provide students, scholars and practitioners alike with a fresh and engaging view of the subject. 'In this masterful and engaging survey, Peter Cane provides an array of illuminating perspectives on the law of torts, laying bare its nature, structure and functions, as well as its legal, social and political context.' The purchase of this ebook edition does not entitle you to receive access to the Connected eBook with Study Center on CasebookConnect. You will need to purchase a new print book to get access to the full experience, including: lifetime access to the online ebook with highlight, annotation, and search capabilities; practice questions from your favorite study aids; an outline tool and other helpful resources. Tort doctrine is complex and nuanced on its own; a torts casebook that mystifies first year students will not help them develop the core skill of legal analysis. Tort Law in Focuspresents concepts in a way that students can understand and apply. Rather than hide the ball, Geoffrey Rapp explains new terms clearly, and guides students in the specific techniques of applying tort law to practice-based problems. Along with concrete examples, Tort Law in Focus provides clear and thorough introductions to those areas of tort law (such as proximate cause under the dominant and new Restatement approaches; res ipsa; factual cause, including but-for cause and alternatives in special cases like indivisible injuries and alternative causes; the duty of owners and occupiers of land; and comparative negligence) that are especially challenging for first-year law students. Professors and Students Will Benefit From: Clear introductions and transitional text that frame key rules, concepts, and cases A wide selection of modern, high-interest cases that apply dominant legal rules, and which, where possible, interpret and apply the Restatement (Third) Summaries and discussion of canonical cases that convey the history and context of modern tort law Examples, flow charts and maps that illustrate concepts, rules, and the relationships among parties and interests Consistent use of problems that encourage students to implement “IRAC” (or equivalent) strategies for structuring their analysis Samples of documents commonly used in tort law practice, such as demand letters and complaints

Studies In American Tort Law written by Vincent R. Johnson and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 1999 with Law categories.

Studies in American Tort Law introduces students to -- but is careful not to overwhelm them with -- law and economics. At appropriate junctures, economic issues are explored, as in connection with the negligence balancing test and the materials on damages, nuisance, and strict liability. The goal is not to view all of tort law through an economic lens, but to employ economic analysis when it is particularly useful. This approach allows professors from the law-and-economics school to use the materials in the text as a starting point for classroom discussions; those who eschew economic analysis can allow the economic commentary to stand on its own.Several features of the book are noteworthy: first, vivid, memorable cases are used as the primary vehicle for teaching torts, but special effort is also made to integrate statutory law into the text. In particular, careful attention is paid to the reflexive process through which judge-made law and legislation influence one another. Second, the significance of liability insurance is highlighted so that students come to appreciate the critical role that insurance plays in the resolution of real cases. Third, ethics notes are included throughout the book for the purpose of sensitizing students to the difficult ethical questions that practicing lawyers face each day. Fourth, the text explorers a number of issues associated with the law and feminism movement that raised questions of social justice of concern to all lawyers. The second edition of Studies in American Tort Law is completely up-to-date. It includes 14 new principal cases, citations to almost 600 new decisions, and a rich selection of materials reflecting the numerous recentlegislative changes to the law of torts. A fully revised second edition of the teacher's manual (Teaching Torts) and student study guide (Mastering Torts) will also be available.
