El matrimonio ha experimentado una evolución que lejos de suponer un desarrollo positivo podría calificarse de una deconstrucción de la institución en su sentido jurídico. Muchos años de técnica jurídica se han vertido en este concepto que, teniendo su origen en Roma, supo adaptarse a los principios cristianos y se perfiló durante siglos por la sedimentación de otros muchos elementos culturales y jurídicos. La concepción del matrimonio presente en nuestra cultura ha estado, sin duda, muy influenciada por el cristianismo, cimiento del edificio doctrinal. Concepción muy rigurosa que se asienta en valores radicales de la persona humana Y que, sin cambios sustanciales significativos, fue asumida por las legislaciones civiles. Sin embargo, de un tiempo a esta parte, en el ámbito civil se está atravesando un momento en el que se observa un lento avance de la autonomía de la voluntad de aquellos que contraen matrimonio y en consecuencia un resurgir de su tratamiento en base al Derecho privado. Ello hace explicable que la actual crisis de valores en la sociedad, haya hecho mella en esa noción del matrimonio y en el Derecho que la sustenta. Hoy día el conjunto doctrinal sobre el que se ha edificado durante siglos el instituto matrimonial es objeto de críticas en puntos importantes. Naturalmente cuando en una sociedad entran en crisis los intereses o valores religiosos, morales, políticos y filosóficos, al tiempo que se acentúa la complejidad cultural dada la convivencia en un mismo territorio de razas, religiones y culturas diversas, inmediatamente el matrimonio queda también afectado. La transformación experimentada por la concepción del matrimonio que en lo civil supone un alejamiento de su origen, junto a la coexistencia con fórmulas matrimoniales religiosas tradicionales –matrimonio canónico, musulmán y hebreo- en un ámbito común, la Unión Europea, que impone un marco normativo de obligado cumplimiento en muchos aspectos, exige un tratamiento comparado para conocer la realidad en la que se inserta hoy el matrimonio religioso.

A partir de ahí, son objeto de estudio algunos de los más característicos sistemas matrimoniales de la órbita del common law, concretamente el inglés, el escocés y el vigente en la República de Irlanda, prestándose una especial atención a las implicaciones que presenta en estos sistemas el concepto legal de confesión religiosa o de fines religiosos así como a la reciente aparición, en algunos de estos modelos, de las novedosas categorías de los llamados matrimonios de creencia y los también denominados matrimonios seculares, con los que se ha abierto la vía al reconocimiento de la eficacia civil de las formas conyugales de ciertos grupos ideológicos o filosóficos distintos de las confesiones religiosas. El libro se cierra con un estudio crítico de las novedades que respecto a la forma de celebración matrimonial ha traído consigo para el sistema español la aprobación de la Ley de la Jurisdicción Voluntaria, realizado precisamente también a la luz de las lecciones que en esta materia cabe extraer del Derecho comparado y especialmente de la reciente evolución experimentada por los mencionados sistemas anglosajones. José Ramón Polo Sabau actualmente es Catedrático de Derecho Eclesiástico del Estado en la Universidad de Málaga. An international joint study by the Food and Agriculture Organization of the United Nations (FAO) and UNESCO's International Institute for Educational Planning (IIEP) was conducted on education and rural development to review the status of the topic from the standpoint of public policies and the conceptual frameworks on which they are based and also to shed light on what may be called "good practice." The findings of the study are meant to serve not as models, but rather as points of reference for all those who are seeking ways of developing education in rural areas and contributing more effectively to rural development. Chapter I, "Education and Rural Development: Setting the Framework" (David Atchoarena and Charlotte Sedel), provides a contextual and theoretical introduction to the new rural development and poverty reduction thinking, as well as a discussion on the contribution of education to rural development. In Chapter II, "Basic Education in Rural Areas: Status, Issues and Prospects" (Michael Lakin with Lavinia Gasperini), the book reviews in depth the provision of basic education in rural areas and offers some policy directions for improvement. Further exploring a particular dimension of basic education, Chapter III, "Making Learning Relevant: Principles and Evidence from Recent Experiences" (Peter Taylor, Daniel Desmond, James Grieshop and Aarti Subramaniam), devotes specific attention to strategies linking the formal school teaching with students' life environment, including agriculture, and to garden-based learning. There has been a widespread resurgence of rights talk in social and legal discourses pertaining to the regulation of family life, as well as an increase in the use of rights in family law cases, in the UK, the US, Canada and Australia. Rights, Gender and Family Law addresses the implications of these developments – and, in particular, the impact of rights-based approaches upon the idea of welfare and its practical application. There are now many areas of family law in which rights and welfare based approaches have been forced together. But whilst, to many, they are premised upon different ethics – respectively, of justice and of care – for others, they can nevertheless be reconciled. In this respect, a central concern is the 'gender-blind' character of rights-based approaches, and the ontological and practical consequences of their employment in the gendered context of the family. Rights, Gender and Family Law explores the tensions between rights-based and welfare-based approaches: explaining their differences and connections; considering whether, if at all, they are reconcilable; and addressing the extent to which they can advantage or disadvantage the interests of women, children and men. It may be that rights-based discourses will dominate family law, at least in the way that social policy and legislation respond to calls of equality of rights between mothers and fathers. This collection, however, argues that rights cannot be given centre-stage without thinking through the ramifications for gendered power-relations, and the welfare of children. It will be of interest to researchers and scholars working in the fields of family law, gender studies and social welfare.
