This book approaches law as a process embedded in transnational personal, religious, communicative and economic relationships that mediate between international, national and local practices, norms and values. It uses the concept "living law" to describe the multiplicity of norms manifest in transnational moral, social or economic practices that transgress the territorial and legal boundaries of the nation-state. Focusing on transnational legal encounters located in family life, diasporic religious institutions and media events in countries like Norway, Sweden, Britain and Scotland, it demonstrates the multiple challenges that accelerated mobility and increased cultural and normative diversity is posing for Northern European law. For in this part of the world, as elsewhere, national law is challenged by a mixture of expanding human rights obligations and unprecedented cultural and normative pluralism enhanced by expanding global communication and market relations. As a consequence, transnationalization of law appears to create homogeneity, fragmentation and ambiguity, expanding space for some actors while silencing others. Through the lens of a variety of important contemporary subjects, the authors thus engage with the nature of power and how it is accommodated, ignored or resisted by various actors when transnational practices encounter national and local law.

An industrial city on the outskirts of Stockholm, Södertälje is the global capital of the Syriac Orthodox Christian diaspora, an ethnic and religious minority group fleeing persecution and discrimination in the Middle East. Since the 1960s, this Syriac community has transformed the standardized welfare state spaces of the city’s neighborhoods into its own “Mesopotälje,” defined by houses with Mediterranean and other international influences, a major soccer stadium, and massive churches and social clubs. Such projects have challenged principles of Swedish utopian architecture and planning that explicitly emphasized the erasure of difference. In The Construction of Equality, Jennifer Mack shows how Syriac-instigated architectural projects and spatial practices have altered the city’s built environment “from below,” offering a fresh perspective on segregation in the European modernist suburbs. Combining architectural, urban, and ethnographic tools through archival research, site work, participant observation (among residents, designers, and planners), and interviews, Mack provides a unique take on urban development, social change, and the immigrant experience in Europe over a fifty-year period. Her book shows how the transformation of space at the urban scale—the creation and evolution of commercial and social districts, for example—operates through the slow accumulation of architectural projects. As Mack demonstrates, these developments are not merely the result of the grassroots social practices usually attributed to immigrants but instead are officially approved through dialogues between residents and design professionals: accredited architects, urban planners, and civic bureaucrats. Mack attends to the tensions between the “enclavization” practices of a historically persecuted minority group, the integration policies of the Swedish welfare state and its planners, and European nativism.

The 'refugee crisis' and the recent rise of anti-immigration parties across Europe has prompted widespread debates about migration, integration and security on the continent. But the perspectives and experiences of immigrants in northern and western Europe have equal political significance for contemporary European societies. While Turkish migration to Europe has been a vital area of research, little scholarly attention has been paid to Turkish migration to specifically Sweden, which has a mix of religious and ethnic groups from Turkey and where now well over 100,000 Swedes have Turkish origins. This book examines immigration from Turkey to Sweden from its beginnings in the mid-1960s, when the recruitment of workers was needed to satisfy the expanding industrial economy. It traces the impact of Sweden's economic downturn, and the effects of the 1971 Turkish military intervention and the 1980 military coup, after which asylum seekers - mostly Assyrian Christians and Kurds - sought refuge in Sweden. Contributors explore how the patterns of labour migration and interactions with Swedish society impacted the social and political attitudes of these different communities, their sense of belonging, and diasporic activism. The book also investigates issues of integration, return migration, transnational ties, external voting and citizenship rights. Through the detailed analysis of migration to Sweden and emigration from Turkey, this book sheds new light on the situation of migrants in Europe.
