Mediating Across Difference is based on a fundamental premise: to deal adequately with conflict—and particularly with conflict stemming from cultural and other differences—requires genuine openness to different cultural practices and dialogue between different ways of knowing and being. Equally essential is a shift away from understanding cultural difference as an inevitable source of conflict, and the development of a more critical attitude toward previously under-examined Western assumptions about conflict and its resolution. To address the ensuing challenges, this book introduces and explores some of the rich insights into conflict resolution emanating from Asia and Oceania. Although often overlooked, these local traditions offer a range of useful ways of thinking about and dealing with difference and conflict in a globalizing world. To bring these traditions into exchange with mainstream Western conflict resolution, the editors present the results of collaborative work between experienced scholars and culturally knowledgeable practitioners from numerous parts of Asia and Oceania. The result is a series of interventions that challenge conventional Western notions of conflict resolution and provide academics, policy makers, diplomats, mediators, and local conflict workers with new possibilities to approach, prevent, and resolve conflict. Despite slow progress in use, mediation continues to consolidate its presence in dispute resolution. This important book argues that a more favourable socio-legal climate must be created for mediation to thrive, and accordingly analyses the legal, cultural, social, systemic and spatial aspects of the use of mediation in the legal practice of the different countries of the European Union (EU). Based on a spatiotemporal analysis and models of mediation in the EU, it pinpoints the social and cultural reasons for the fragmentation of its legal regulation and shows what paths are available to promote the effective implementation of mediation in social practice. It is the first book to capture the socio-legal context of mediation. A spatiotemporal analysis of the extent of use of mediation in a region as large and at the same time as diverse as the EU has never been carried out before. Central to a transformational approach to conflict is the idea that conflicts must be viewed as embedded within broader relational patterns, and social and discursive structures—and must be addressed as such. This implies the need for systemic change at generative levels, in order to create genuine transformation at the level of particular conflicts. Central, also, to this book is the idea that the origins of transformation can be momentary, or situational, small-scale or micro-level, as well as bigger and more systemic or macro-level. Micro-level changes involve shifts and meaningful changes in communication and related patterns that are created in communication between people. Such transformative changes can radiate out into more systemic levels, and systemic transformative changes can radiate inwards to more micro- levels. This book engages this transformative framework. This book examines the practice of transitional justice in the Solomon Islands from the period of the ‘The Tensions’ to the present. In late 1998, the Solomon Islands were plunged into a period of violent civil conflict precipitated by a complex web of grievances, injustices, ethnic tensions, and economic insecurities. This conflict dragged on until the middle of 2003, leaving an estimated 200 people dead and more than 20 000 displaced from their homes. In the time that has elapsed since the end of The Tensions, numerous—at times incompatible—approaches to transitional justice have been implemented in the Solomon Islands. This is the first critical monograph to explore and delineate the emergent field of witness literature across fiction, nonfiction, memoir, journalism and survivor testimony from the Global South. Witness Literature examines writing from three sites of exceptional violence and fluid justice: the Cambodian Genocide, the Sri Lankan civil war and the borderscapes of honour-based violence in Jordan, Pakistan, Turkey/Türkiye, the UK and beyond. Drawing on the intersecting fields of literary analysis, biopolitics, testimony studies, trauma theory and postcolonial studies, this book examines the place of the fictive in writings of traumatic events; takes up the call to expand Western understanding of the normatively human by focusing on work that bears witness from sites of compromised belonging; and shows how witness literature by migrant subjects marks an important intervention in Western readings of trauma.
