The film 'Reefer Madness'1 propagandized the evil effects of marijuana in the 1930s.2 Nearly 83 years later, marijuana is largely decriminalized, chiefly for medicinal purposes. Less melodramatic than the side effects portrayed in Reefer Madness is the reality of how employment law will be impacted by medicinal marijuana use. Ordinarily, the Americans with Disabilities Act (“ADA”) would sufficiently address employee protections and permissible adverse employment actions, and, where it fails to provide guidance, surely state law would fill the gap. However, the current state of marijuana law presents a bizarre dilemma: how does a local or state jurisdiction regulate a medically and lawfully recommended drug that is outlawed federally? Does marijuana's federal classification as a Schedule I drug permit an employer to claim preemption under the Supremacy Clause of the Constitution to avoid liability for adverse employment actions, such as discrimination, when state law would otherwise permit damages to be awarded? Where does an employee find balance between medical necessity and an organization's business risk associated with medicinal side effects of marijuana? Why is reasonable accommodation even a legal answer for a drug used off site and after work hours? The current answers to these questions are divisive, pitting employer against employee and circuit against circuit. Yet the application of employment law is not at conflict with federal mandates. As this article will argue, the shortcomings of the ADA can therefore be remedied by applying an equitable balancing test to medical marijuana discrimination claims.

If sound policy is to be made on the issue of marijuana in the workplace, all available empirical evidence about its impact on job performance should be utilized in the decision process. Although a substantial amount of relevant research has been done, the results published in journals in widely divergent fields, are not easily summarized and present no single, simple message for decision makers. Schwenk and Rhodes offer a unique review of this complex body of work and challenge the many highly publicized but scientifically unsound mythical numbers touted as supporting various policy options. The authors provide a clear and objective presentation to managers on how to evaluate the evidence for themselves and make sound decisions for their own organizations. Scrupulously unbiased in its choice of material, the book will be an essential resource for organizational and public policy makers, and for university students and their teachers. The effect of marijuana on job performance has been widely accepted as harmful—but is it? Congress thought so, and in 1988, used productivity losses which it attributed to marijuana and other drugs to justify passage of legislation initiating a mandate for a drug-free workplace. Additional legislation expanding this mandate followed and a high percentage of large corporations and an increasing number of small businesses now expend scarce resources on anti-drug programs. Schwenk and Rhodes remain neutral in the debate over workplace drug policies, but argue that policy should be informed by empirical research on the impact of marijuana on job performance. Their book is both a challenge to the mythical numbers so often publicized as supporting a particular advocate's vested position, and a guide to both practitioners and scholars to help them evaluate the diverse body of existing evidence and the claims made by those committed to given policy positions. Schwenk and Rhodes reprint examples of high quality research previously published in major journals in the fields of psychology, anthropology, economics and medicine. Reviewing and summarizing existing findings, the authors relate these findings to the decision situations faced by policy-makers in the private and public sectors. While the book refuses to endorse any decision outcome with regard to marijuana and the workplace, it makes strong recommendations about the ^Iprocesses^R that should be used in selecting those outcomes. It provides guidelines for evaluating policy-relevant social scientific evidence and discusses the role such evidence can and should play in policy-making. The book shows that contrary to widely held beliefs, very little evidence that the substance has a consistent negative effect on worker productivity. Though social science does not show that resources devoted to creating a drug-free workplace are likely to pay off economically, the authors stress that the implications of this fact for corporate and government decisions are not cut and dried, but depend on the decision rules and the policy goals selected by policy-makers. This book will be an essential tool for managers, scholars, and anyone trying to make sense of the complicated and confusing maze of data and arguments surrounding this divisive issue.

Legalization of medical marijuana is a growing trend among states: 16 states and DC have medical marijuana laws, 13 states have decriminalized possession of small amounts, and 80% of Americans support allowance of medical marijuana to treat pain, this article notes. Based on this trend, it seems employees using marijuana with a valid prescription would have protection; If it is legal in my state, medical marijuana must be treated like any other prescription drug, right? Wrong, this paper shows. Courts have made it clear that, so far, there is no protection for employees who fail their company's drug test because they tested positive for marijuana they use pursuant to state law. By looking at various cases on both the state and Federal level, this article outlines this tension and the ensuing confusion it causes both employees and employers. The article also points towards likely future trends in court decisions and illuminates two seminal, dissenting Federal arguments that might provide useful guidelines for managers. Some employers want to accommodate marijuana and create workplace policies that reflect a new view of off-duty use of medical marijuana. The courts may have given management a blueprint for an effective workplace drug policy that allowed for some medical marijuana use. But whether these guidelines can adequately and appropriately address the very real concerns for employers about drug use in the workplace today remains a decision managers are making on a piecemeal basis.

Currently, twenty-one states and the District of Columbia have enacted legislation providing an affirmative defense to prosecution under state law for medical marijuana use by qualified patients. Despite growing public and legislative support for the legalization of medical marijuana, medical marijuana use -- either recreational or medicinal -- remains illegal under the Federal Controlled Substances Act. Given the inconsistency between state and federal law concerning the legality of medicinal marijuana, there is significant uncertainty regarding the rights of employees to engage in state-sanctioned, off-duty use of medical marijuana. To date, courts have refused to grant protections to employees' who have suffered adverse employment action for their off-duty, state-sanctioned medical marijuana use. Although the existing case law appears employer-friendly, employee-friendly dissenting opinions and states that have adopted explicit statutory discrimination protections for medical marijuana users signify that this current trend could easily change. This Note argues that courts should allow employees' claims for disability discrimination to proceed under state law, and state legislatures should amend their current medical marijuana statutes to afford employment discrimination protection to qualified patients. In doing so, states will be able to protect disabled employees from discrimination due to their use of a state sanctioned therapeutic remedy.
