There can be few aspects of life which have altered so dramatically in the past few decades as the relationship between medicine and the law. Treatments become more and more sophisticated as each advance in medicine is made. At the same time, the legal and moral issues surrounding such treatments have multiplied and have become increasingly sensitive and complex. Introducing the reader to important topics which include genetics, consent, negligence, research, assisted reproduction and mental health, the book outlines what the current law is, why it is so and what it may become in the future. Legal and Ethical Aspects of Healthcare is written by a lawyer and a doctor, each with extensive practical experience in the field. It provides wide-ranging coverage of the most important ethical and moral issues that face healthcare professionals, lawyers and the general public alike and it offers a unique insight into the problems that healthcare providers and patients can be expected to encounter both today and in the future. All healthcare professionals at any level of training or practice, lawyers and interested members of the general public. Book jacket.

A 70-year-old woman bed-bound following a stroke has developed bronchopneumonia, but her daughter produces an advance directive that she says her mother has written, which states that no life-sustaining treatment is to be given. How are you going to proceed? A practical guide on how to approach the legal and ethical dilemmas that frequently occur in hospital wards and medicine in the community, 100 Cases in Clinical Ethics and Law explores typical dilemmas through the use of 100 common medical scenarios. The book covers issues such as consent, capacity, withdrawal of treatment and confidentiality, as well as less-frequently examined problems like student involvement in internal examinations, whistle-blowing and the role of medical indemnity providers in complaints. Each scenario has a practical problem-solving element to it and encourages readers to explore their own beliefs and values, including those that arise as a result of differing cultural and religious backgrounds. Answer pages highlight key points in each case and provide advice on how to deal with the emotive issues that occur when practising medicine, at the same time providing information and guidance on appropriate behaviour.

I. OVERVIEW Legal Issues in Mental HeaIth Care is aimed at the mental health clinician who provides services on either an inpatient or an outpatient basis. It is written for psychiatrists, psychologists, social workers, nurses, and other therapists to help them understand and manage legal issues in their daily practice. The issues covered apply to therapists who work for an agency or hospital as weil as those who work independently. The book is meant to serve as a handbook, but it also provides a quick resource as legal questions arise which are related to the obligations of the therapist. It ad dresses the legal issues that confront the clinician. It is not aimed at the clinicianwho specializes in forensie mental health issues, because the information provided does not reach that level of detail or sophistication. Nor is it aimed at the scholar, because our goal is to provide practical information in a clear and concise format. Wehave not addressed the wide array of laws protecting the mentally disabled from discrirnina tion-most notably, the Americans with Disabilities Act (1990)and the Fair Housing Act. Most states also have laws that prohibit discrimination in employment, services, and housing. These issues are beyond the scope of this book because we are address ing the legal issues that arise in providing care, rather than the rights of mentally disabled persons. 11. ORGANIZATION OF THE BOOK The book consists of eleven chapters and a Glossary of Legal Terms.

Why write another book on ethics? As practitioners we are involved both in the design and delivery of services to people with mental health problems. In common with all other professionals, our work has led to the experience of ethical dilemmas: typically, these have involved major confrontations, either with our col leagues or our consciences. This book, however, is not limited to a discussion of such major themes. Rather, we have tried to use a broader canvas: ethics, in our view, is really about the judgement of right and wrong in ordinary, everyday life. Ethics are highly personal: we fashion our own personal code from our experi ence of others, and from the 'tests' which bring meaning to our lives. Such experiences shape our individual values. We bring these codes and values to our work. We are not always aware of their influence in our dealings with people. Although we may not always be aware of it, all our actions pose an ethical question. Given that our work involves us in helping others to live ordinary, satisfying lives, this challenge heightens the intensity of our ethical dilemmas. This is most evident where our personal code conflicts with the implicit code of the health setting.
