El análisis, evaluación e implementación de la calidad de las normas jurídicas constituye ya una exigencia ineludible en las democracias avanzadas. A la mejora de esa calidad contribuye, sin duda, la participación en su elaboración de órganos independientes y técnicamente prestigiosos como el Consejo de Estado, cuya auctoritas los órganos consultivos de las Comunidades Autónomas, en plena fase de consolidación institucional, pretenden alcanzar. La participación de estos órganos en el procedimiento normativo sigue estando delimitada por los viejos conceptos de reglamento ejecutivo e independiente, que en este libro se diseccionan de forma minuciosa. La jurisprudencia del Tribunal Supremo y la doctrina del Consejo de Estado nos muestran cómo, aunque de forma incompleta y sin gran consistencia teórica, puede observarse una ampliación de los tipos de reglamentos que se consideran ejecutivos y se reducen, en consecuencia, los que aún no se benefician de su intervención. En este libro se propone culminar definitivamente este proceso, prescindir de dichos conceptos y que la intervención del Consejo de Estado se extienda a todos los proyectos normativos, tanto de rango legislativo como reglamentario. El análisis jurídico ha sido el método tradicional de análisis del Consejo de Estado, pero en este libro se analiza su creciente atención a la calidad normativa en sus aspectos formales, procedimentales y sustantivos (eficacia y eficiencia) y concluye con algunas propuestas para fomentar el debate sobre cómo estos órganos pueden contribuir adicionalmente, sin merma de su independencia, prestigio técnico y sin ser objeto de la politización que han sufrido otros órganos constitucionales, a profundizar en la mejora del buen gobierno y buena administración en la convulsa España del siglo xxi.

La mejora de la calidad normativa y su posterior evaluación forman parte de las preocupaciones actuales de nuestro Derecho público. No obstante, hasta fechas muy recientes, principalmente por influencia de modelos anglosajones y, muy particularmente, de la Unión Europea, no se han ido introduciendo medidas en este ámbito, y su desarrollo hasta hoy tampoco ha sido demasiado satisfactorio. El presente estudio analiza los problemas y las ineficiencias del modelo español para la mejora de la calidad normativa y trata de sistematizar una serie de propuestas a través del diseño de un nuevo modelo de producción y evaluación normativa.
