This book, first published in 1988, argues that a close inspection of the development of Hanafite law in the Mamluk and Ottoman periods reveals changes in legal doctrine which were not restricted to civil transactions but also concerned the public law. It focuses in particular on the interrelated areas of property, rent and taxation of arable lands, arguing that changes in the relationship between tax and rent led to a redefinition of the concept of landed property, a concept at the very heart of the Islamic legal system. This title will be of particular interest to students of Islamic history.

"The Dutch colonial power in Indonesia in the nineteenth century needed to clarify its understanding of the legal values and conventions of the peoples whom it claimed to rule. Dutch colonial lawyers tended to rationalize this legal culture, lumping together all kinds of indigenous legal customs from different areas as manifestations of adatrecht, or, customary law. The status of this legal system vis-a-vis Dutch colonial law was a source of continual depute and disagreement. The champions of adatrecht known as the Leiden School, with C. van Vollenhoven in the forefront, scored a victory around 1927 when adatrecht gained official recognition, though on the other hand it became the subject of mounting criticism. After World War II, the independent state of Indonesia paid lip service to adatrecht principles, but in practice treated it as irrelevant, or even an embarrassment."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc. Decentralization is sweeping the world and having dramatic and far-reaching impacts on resource management and livelihoods, particularly in forestry. This book is the most up-to-date examination of the themes, experiences and lessons learned from decentralization worldwide. Drawing on research and support from all of the major international forestry and conservation organizations, the book provides a balanced account that covers the impact of decentralization on resource management worldwide, and provides comparative global insights with wide implications for policy, management, conservation and resource use and planning. Topics covered include forest governance in federal systems, democratic decentralization of forests and natural resources, paths and pitfalls in decentralization and biodiversity conservation in decentralized forests. The book provides in-depth case studies of decentralization from Bolivia, Ghana, Indonesia, Russia, Scotland, Switzerland, Uganda and the US, as well as highlights from federal countries including Australia, Brazil, Canada, India and Malaysia. It also addresses the critical links between the state, forests, communities and power relations in a range of regions and circumstances, and provides case examples of how decentralization has been viewed and experienced by communities in Guatemala, Philippines and Zimbabwe. The Politics of Decentralization is state-of-the-art coverage of decentralization and is essential for practitioners, academics and policy-makers across forestry and the full spectrum of natural resource management.

Pure Theory Of Law written by Hans Kelsen and has been published by The Lawbook Exchange, Ltd. this book supported file pdf, txt, epub, kindle and other format this book has been release on 2005 with Law categories.

Reprint of the second revised and enlarged edition, a complete revision of the first edition published in 1934. A landmark in the development of modern jurisprudence, the pure theory of law defines law as a system of coercive norms created by the state that rests on the validity of a generally accepted Grundnorm, or basic norm, such as the supremacy of the Constitution. Entirely self-supporting, it rejects any concept derived from metaphysics, politics, ethics, sociology, or the natural sciences. Beginning with the medieval reception of Roman law, traditional jurisprudence has maintained a dual system of "subjective" law (the rights of a person) and "objective" law (the system of norms). Throughout history this dualism has been a useful tool for putting the law in the service of politics, especially by rulers or dominant political parties. The pure theory of law destroys this dualism by replacing it with a unitary system of objective positive law that is insulated from political manipulation. Possibly the most influential jurisprudent of the twentieth century, Hans Kelsen [1881-1973] was legal adviser to Austria's last emperor and its first republican government, the founder and permanent advisor of the Supreme Constitutional Court of Austria, and the author of Austria's Constitution, which was enacted in 1920, abolished during the Anschluss, and restored in 1945. The author of more than forty books on law and legal philosophy, he is best known for this work and General Theory of Law and State. Also active as a teacher in Europe and the United States, he was Dean of the Law Faculty of the University of Vienna and taught at the universities of Cologne and Prague, the Institute of International Studies in Geneva, Harvard, Wellesley, the University of California at Berkeley, and the Naval War College. Also available in cloth.

This book presents an account of an intellectual breakthrough in the study of rural society and agriculture. Its ten chapters, selected for their originality and synthesis from the colloquia of the Program in Agrarian Studies at Yale University, encompass various disciplines, diverse historical periods, and several regions of the world. The contributors' fresh analyses will broaden the perspectives of readers with interests as wide-ranging as rural sociology, environmentalism, political science, history, anthropology, economics, and art history. The ten studies recast and expand what is known about rural society and agrarian issues, examining such topics as poverty, subsistence, cultivation, ecology, justice, art, custom, law, ritual life, cooperation, and state action. Each contribution provides a point of departure for new study, encouraging deeper thinking across disciplinary boundaries and frontiers.
