Das allgemeine Ziel, die Achtung der Menschenrechte zu fördern und zu festigen, ist bereits in der UN-Charta von 1945 niedergelegt. Diesem Ziel dienen die Allgemeine Erklärung der Menschenrechte (AEMR) von 1948 sowie die darauf aufbauenden Kernabkommen des internationalen Menschenrechtsschutzes der Vereinten Nationen. Die allermeisten Rechte der AEMR – eigentlich besser übersetzt als "Universelle Erklärung der Menschenrechte" – wurden 1966 in zwei völkerrechtliche Verträge überführt, den Internationalen Pakt über bürgerliche und politische Rechte sowie den Internationalen Pakt über wirtschaftliche, soziale und kulturelle Rechte, die beide 1976 in Kraft traten. Sie wurden im Laufe der Zeit durch weitere internationale Abkommen ergänzt. Internationale Menschenrechtsabkommen sind "living instruments". Die Auslegung der rechtlich verankerten Menschenrechte ist nicht starr. Viele völkerrechtliche und politische Debatten kreisen um eine zeitgemäße Auslegung bestehender Rechte. Auch das Verständnis davon, wer Träger der Menschenrechte ist und wen die Menschenrechte auf welche Weise verpflichten, ist Veränderungen unterworfen. Zugleich kann der "Katalog" der Menschenrechte im Rahmen weiterer Abkommen verändert und erweitert werden. Die historische Entwicklungsoffenheit der Menschenrechte bedeutet allerdings nicht Beliebigkeit: Die Festschreibung neuer und die Neu-Interpretation bestehender Menschenrechte sind zwar notwendig, um "neuen" Unrechtserfahrungen und veränderten Lebensbedingungen Rechnung zu tragen, doch sind sie stets daraufhin zu prüfen, ob und inwiefern sie sich in das systematische Gefüge des Menschenrechtsschutzes einbetten lassen. Zugleich sind Menschenrechte aber auch nicht vor Rückschritten gefeit.

HauptbeschreibungDie Arbeit beschnftigt sich mit der Frage, ob und inwieweit die Vertragsparteien der EMRK und des IPBPR bei der Vornahme von Kriegshandlungen in einem internationalen bewaffneten Konflikt an ihre Verpflichtungen aus diesen Abkommen gebunden sind. Nach einem berblick ber die Unterschiede und Gemeinsamkeiten der Menschenrechtsabkommen und des KriegsvAlkerrechts werden als Vorfragen die Fortgeltung der Menschenrechtsabkommen wnhrend eines bewaffneten Konflikts und die Reichweite ihres (extraterritorialen) Geltungsbereichs behandelt. Den Hauptteil der Arbeit bildet die Untersuchung des Verhnltnisses zwischen den Menschenrechtsabkommen und dem KriegsvAlkerrecht. Ausgangspunkt ist hier die allseits vertretene These, es handele sich beim KriegsvAlkerrecht um das im bewaffneten Konflikt anzuwendende lex specialis, deren Stichhaltigkeit berprft wird. Der Autor kommt dabei zu dem Ergebnis, dass es sich beim KriegsvAlkerrecht jedenfalls nicht um ein geschlossenes Regelungssystem handelt, das die Anwendung der Menschenrechtsabkommen insgesamt sperrt. Aber auch fr die Verdrnngung einzelner menschenrechtsvertraglicher Normen durch speziellere kriegsvAlkerrechtlichen Normen besteht nach Auffassung des Autors mangels relevanter Normenkonflikte nur wenig Raum. Die lex specialis-These kann daher in der Regel nur dahingehend verstanden werden, dass die Menschenrechte im Lichte des KriegsvAlkerrechts auszulegen sind. Soweit eine Harmonisierung des menschenrechtsvertraglichen und des kriegsvAlkerrechtlichen Pflichtenumfangs im Wege der Auslegung nicht mAglich ist, plndiert der Autor fr einen Rckgriff auf die in den Menschenrechtsabkommen enthaltenen Derogationsklauseln."
