This book analyses the multifaceted ways law operates in the context of human mobility, as well as the ways in which human mobility affects law. Migration law is conventionally understood as a tool to regulate human movement across borders, and to define the rights and limits related to this movement. But drawing upon the emergence and development of the discipline of mobility studies, this book pushes the idea of migration law towards a more general concept of mobility that encompass the various processes, effects, and consequences of movement in a globalized world. In this respect, the book pursues a shift in perspective on how law is understood. Drawing on the concepts of ‘kinology’ and ‘kinopolitics’ developed by Thomas Nail as well as ‘mobility justice’ developed by Mimi Sheller, the book considers movement and motion as a constructive force behind political and social systems; and hence stability that needs to be explained and justified. Tracing the processes through which static forms, such as state, citizenship, or border, are constructed and how they partake in production of differential mobility, the book challenges the conventional understanding of migration law. More specifically, and in revealing its contingent and unstable nature, the book reveals how human mobility is itself constitutive of law. The Admission and Integration of Refugees in Europe argues for a more interconnected understanding of laws and policies for the admission and integration of refugees and asylum seekers in the European Union. Admission and integration normally refer to different phases of the migratory process, but this demonstrates that they are inherently interconnected. Certain legal statuses conferred in admission procedures are directly relevant for the integration prospects of migrants, and the success or failure to integrate has potential repercussions for residence rights, although refugees are in that respect better protected than other immigrants. Legal pluralism further complicates the European context, as admission is often seen as under European Union jurisdiction, and integration as a Member State consideration. However, the book argues that this legal pluralism in fact helps us to better explain how interaction between admission and integration takes place across laws and legal orders. The rule of law, or Rechtsstaatsprinzip, is one of Germany's oldest constitutional principles and forms part of Germany's constitutional self-understanding. This book critically examines to what extent this key constitutional principle has translated into a reality for all. The book provides a comprehensive insight into rule of law experiences and discourses in Germany. It explores Germany's long rule of law tradition and highlights where the German state has fallen short of its rule of law promise, using historical and contemporary examples. It also shows that Germany's rule of law experience is tightly interwoven with European and international rule of law debates. By integrating historical, socio-legal and doctrinal perspectives, the book provides a nuanced account of a foundational principle in German constitutional thought. Dedicated chapters explore the history and doctrine of the rule of law, challenges to the rule of law in today's Germany, the rule of law experience in the former German Democratic Republic and in the context of reunification, the relationship of the German rule of law practice with the rule of law on the European and international level, and the rule of law in times of crisis.
