Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph on the rules on immigration and right of residence of non-nationals in Spain examines the legal and administrative conditions for persons not having the citizenship of a State to enter the country and to stay and reside there. It provides a survey of the subject that is both usefully brief and sufficiently detailed to answer most questions likely to arise in any pertinent legal setting. It follows the common structure of all monographs appearing in the International Encyclopaedia for Migration Law, thus allowing easy comparison between the country studies. As migration and economic activities are often interlinked, the analysis pays particular attention to labour market access and regulation of self-employed activities for non-nationals. The book describes the status of such specific categories of persons as students, researchers, temporary workers, and asylum seekers, as well as the position of family members, detailing applicable legislation and providing practical information on administrative procedures, sanctions, and legal remedies and guarantees. The impact of international human rights law and various bilateral and multilateral agreements is considered, along with the broader application of national and local law to non-citizens in such areas as family relations, labour, social security, and education. Lawyers, scholars, practitioners, policymakers, government administrations, and non-governmental organizations involved in the development, practice and study of migration law will find this book indispensable. It will be welcomed by lawyers representing parties with interests in Spain and immigration specialists in both public and private organizations. Academics and researchers also will appreciate its value in the study of comparative trends and harmonization initiatives affecting migrants.

This thorough analysis of immigration governance in Spain explores the dynamics of inclusion and exclusion at play at one of Europe’s southern borders. Drawing on interviews with policymakers and from parliamentary debates, laws, and policy documents, David Moffette reveals the complicated legal obstacles facing migrants with precarious immigration status. He shows how issues of culture, labour, and security intersect to create a regime of migration governance that is at once progressive and repressive. This book contributes to debates in socio-legal, border, and citizenship studies.

Ceuta and Melilla are two ‘enclaves’ on the northern coast of Africa that have been Spanish for centuries but that are claimed by the Kingdom of Morocco. As an integral part of Spain the towns have also been part of the territory of the European Union since 1986. Their unique situation has created considerable tension in the relationship (both political and economic) between Spain and Morocco. As well as looking at this relationship, the book explains how the anomalous situation of the enclaves impinges on issues such as immigration from North and sub-Saharan Africa into the EU, defence, trade and the Spanish political scene in general.

This provocative volume explores immigration law in Spain and Italy, and exposes the tension between the temporary legal status of most immigrants, and the government emphasis on integration. It demonstrates the connections among immigrants' role as cheap labor--carefully inscribed in law--and their social exclusion and racialization. At the broadest level, the book engages questions of citizenship and belonging in this global era. It uniquely combines analysis of immigration laws and immigrants' daily experiences.

This open access book provides a unique study of the complexities and consequences of irregular legal status of Senegalese migrants in Europe. It employs sophisticated quantitative methods to analyze unique life-history data to produce policy-relevant conclusions. Using the MAFE dataset as empirical evidence, the book focuses on the legal paths of Senegalese migrants in three different European countries. It shows how multiple contexts of reception produce pathways into irregular legal status and how the resulting complex configurations of irregular status shape migrants’ economic integration into their host societies as well as their ongoing participation in the development of their sending societies. The book thereby increases our understanding of the functioning of African migration systems and the corresponding inclusion patterns in Europe. As such this book will be of interest to scholars working in migration studies, policy makers, and legal professionals.

This open access book provides an analysis of the functioning, consequences and inherent limitations of internalised immigration control. By adopting the perspective of irregular residents as well as local service providers, the book sheds new light on the intricate mechanisms that either help or hinder the diffusion of immigration control into concrete institutional settings, like schools or hospitals. A simple and innovative analytical framework enables the systematic comparison of three different spheres of service provision across two distinct local as well as also national contexts. This is necessary to understand the complex interplay between formal law and policy, the intrinsic rules and logics operating within institutions, and the ethical or practical obligations and constraints attached to particular roles and professions. Based on empirical findings and rigorous analysis, the book argues that internalised control is part of the problem that irregular migration poses for society, rather than constituting a potential solution to it.

'Combating' irregular migration is one of the key challenges to migration management at EU level. This book addresses one of the most pressing structural problems regarding the EU's return policy: the low return rate of irregularly staying migrants. In this regard the EU Return Directive obliges Member States to issue a return decision, yet only 40% of such decisions are enforced annually. Moreover, despite the political and legal efforts, the EU is not making any significant progress in enforcing the rules it has laid down in the Return Directive. The legislation of EU Member States may, however, serve as a source for possible solutions to 'combat' the problem of irregularly staying migrants. It is for this reason that the book compares the system of regularisations in Austria, Germany and Spain. Regularisations constitute an effective alternative to returns because they terminate the irregular residence of migrants, not through deportation, but rather by granting a right of residence. Regularisation is therefore understood as each legal decision that awards legal residency to irregularly staying migrants. As is shown by the examination and comparison of regularisations in Austria, Germany and Spain, differentiated systems of regularisation exist at national level. However, EU regularisations supplementing the present return policy would be more effective at 'combating' irregular migration at EU level.

At a time when issues concerning migration and the formation of diasporic communities have come to be critical for all European legal systems, this volume reflects, discusses and analyzes the questions raised by diasporas who have established themselves in Europe over more than fifty years of immigration and the challenges faced by legal systems in the light of continued migration. Contributors from a broad range of backgrounds address prominent issues ranging from legal pluralism among minorities, pressures on EU accession states, irregular migration, state control of family reunification and formation in light of human rights laws, challenges for citizenship and nationality laws and the implementation of visa rules and juxtaposed control zones. Besides the EU as a supranational legal order, the book contains discussion of conditions in the United Kingdom, Ireland, France, Spain, Gibraltar, Morocco, Greece, Turkey and Lithuania. This volume accompanies The Challenge of Asylum to Legal Systems and is the second book to emerge from the W.G Hart Legal Workshop held in 2004 at London's Institute for Advanced Legal Studies.
