In-work poverty is a reality for too many persons in the European Union (EU). Although everyone is in agreement that poverty must be reduced, rarely is there a specific focus on the plight of those who, despite working, are poor. This important book is the first to unreservedly meet the challenge of defining, measuring, and comparing the legal regimes to combat in-work poverty in Europe, fully attending to the strengths and shortcomings of indicators and allowing the assessment of comparative best practices among the Member States. The distinguished contributors each describe and analyse this complex and multidimensional phenomenon, with its manifold and intertwined causes, in relation to such factors as the following: employment-related factors (wage, type of contract, atypical employment); worker’s socio-demographic characteristics (level of education, gender, age, country of birth); size and composition of household; household work intensity; and institutional factors (childcare, flexible work arrangements, employment protection, housing, technological change). In a major innovation, the book’s methodology approaches the ‘working poor’ by distinctly defining four groups of vulnerable and under-represented persons (VUPs) with detailed statistical information on in-work poverty in each group. Following an in-depth introduction focusing on the definition and ramifications of the concept of in-work poverty – including a discussion of legal scholarship and relevant EU instruments – the situations in seven EU Member States (Belgium, Germany, Italy, Luxembourg, the Netherlands, Poland, and Sweden) are compared, revealing important variations. For each of the VUP groups, these chapters explain their composition at the national level and assess the impact of regulation on the incidence of in-work poverty. The last chapter highlights differences and similarities in an attempt to find patterns and identify common regulatory problems and best practices. The book’s comparative perspective greatly assists in understanding in-work poverty determinants, appraising varieties of relevant national policies, and stimulating the development of effective legal measures. With its close analysis of the limitations of existing measurement indicators, the book sheds light on the role of regulation in the prevalence and persistence of the phenomenon and equips policymakers at the EU and national levels with targeted tools to tackle this severe social problem.

This book analyses the European Court of Justice's power from a political-science perspective. It argues that this power can be assessed through studying the policy implications of there being a supranational constitution that was drafted as an international treaty. An international treaty contains a set of policy goals for future cooperation. Direct effect and supremacy give constitutional status to these policy goals, allowing the Court to develop the Treaty's implications for policymaking at the European and the member-state levels. By focusing on the four freedoms (of goods, services, persons, and capital) and citizenship rights, the book analyses the implications of case law for policymaking in different case studies. It shows how major EU legislation (for instance, the Services and Citizenship Directives) are significantly influenced by case law and how controversial policies, such as EU citizens' access to tax-financed social benefits, are closely linked to the Court.

Um die Jahrhundertwende, in den Jahren 1999 und 2003, wurde diese innerhalb kürzester Zeit durch zwei Reformen jeweils komplett neu geregelt. Anfang dieses Jahres hat der Bundesvorstand des Deutschen Gewerkschaftsbundes, aufgrund der großen Relevanz für Arbeitnehmer/innen in Deutschland, beschlossen eine weitere Neuordnung der sogenannten Minijobs vorzuschlagen. Gemäß der Zahlen des Berichts der Deutschen Rentenversicherung Knappschaft-Bahn-See zu den aktuellen Entwicklungen im Bereich der geringfügigen Beschäftigung für das erste Quartal 2012 würde eine Änderung in diesem Bereich derzeit 6.916.978 Arbeitnehmer/innen im gewerblichen Bereich und 242.743 in Privathaushalten betreffen, bei einer gesamten Erwerbsbevölkerung von 41,579 Millionen in Deutschland. Hinzu kommt, dass sich die Zahl der Minijobber innerhalb einer Dekade, ausgehend von 4.183.791 im Dezember 2002, fast verdoppelt hat und nun etwa 17 Prozent der Erwerbstätigenquote ausmacht. Angesichts dieser Zahlen und kontinuierlicher Reformbestrebungen wird deutlich, dass es sich bei dieser Beschäftigungsform weder um eine Randerscheinung handelt, noch eine allen Anforderungen entsprechende Regelung besteht; aus diesem Grund soll das politische Instrument ‚Minijob‘ hier genauer betrachtet werden. Minijobs werden kontrovers diskutiert und je nach Perspektive unterschiedlich bewertet. So wurde auch in einer Augustausgabe des Spiegels ein sich vom oben genannten deutlich unterscheidender Reformvorschlag der CDU und FDP diskutiert. In dieser Hausarbeit sollen daher das bisherige politische Konzept und dessen Umsetzung analysiert werden, um abschließend zu beurteilen, inwiefern die mit der Reform 2003 angestrebten Ziele erreicht worden sind und, ob weiterer Reformbedarf besteht. Zu diesem Zweck wird zunächst die geschichtliche Entwicklung der geringfügigen Beschäftigung an Hand der bis 1999 durchgeführten Reformen aufgezeigt. Anschließend wird die Reform des Jahres 1999 dargestellt. Im zweiten Teil wird auf die Rechtsgrundlage und die aktuelle Gestaltung des Konzepts eingegangen, um anschließend die Ziele der Reform 2003 darzulegen. Eine Erfolgsbilanz, ob die zuvor definierten Ziele erreicht oder verfehlt worden sind, wird im dritten Teil gezogen. In recent years, the German government has intentionally expanded the low-wage work sector in an effort to reduce exceptionally high levels of unemployment. As a result, the share of the German workforce employed in low-paying jobs now rivals that of the United States. Low Wage Work in Germany examines both the federal policies and changing economic conditions that have driven this increase in low-wage work. The new "mini-job" reflects the federal government's attempt to make certain low-paying jobs attractive to both employers and employees. Employers pay a low flat rate for benefits, and employees, who work a limited number of hours per week, are exempt from social security and tax contributions. Other factors, including slow economic growth, a declining collective bargaining system, and the influx of foreign workers, also contribute to the growing incidence of low-wage work. Yet while both Germany and the United States have large shares of low-wage workers, German workers receive health insurance, four weeks of paid vacation, and generous old age support—benefits most low-wage workers in the United States can only dream of. The German experience offers an important opportunity to explore difficult trade-offs between unemployment and low-wage work.
