The egalitarian case against marriage is the most fundamental argument of Against Marriage. But Chambers also argues that state-recognised marriage violates liberty, including the political liberalversion of liberty that is based on neutrality between conceptions of the good.Part Two sets out the case for the marriage-free state. Chambers criticizes recent arguments that traditional marriage should be replaced with either a reformed version of marriage, such as civil partnership, or a purely contractual model of relationship regulation. She then sets out a new model forthe legal regulation of personal relationships. Instead of regulating by status, the state should regulate relationships according to the practices they involve. Instead of regulating relationships holistically, assuming that relationship practices are bundled together in one significantrelationship, the marriage-free state regulates practices on a piecemeal basis. The marriage-free state thus employs piecemeal, practice-based regulation. It may regulate private marriages, including religious marriages, so as to protect equality. But it takes no interest in defining or protectingthe meaning of marriage.

This book is a defense of political liberalism as a feminist liberalism. The first half of the book develops and defends a novel interpretation of political liberalism. It is argued that political liberals should accept a restrictive account of public reason and that political liberals' account of public justification is superior to the leading alternative, the convergence account of public justification. The view is defended from the charge that such a restrictive account of public reason will unduly threaten or undermine the integrity of some religiously oriented citizens and an account of when political liberals can recognize exemptions, including religious exemptions, from generally applicable laws is offered. In the second half of the book, it is argued that political liberalism's core commitments restrict all reasonable conceptions of justice to those that secure genuine, substantive equality for women and other marginalized groups. Here it is demonstrated how public reason arguments can be used to support law and policy needed to address historical sites of women's subordination in order to advance equality; prostitution, the gendered division of labor and marriage, in particular, are considered.

Marriage is central to Indonesia’s social fabric and critical in defining socially legitimate relationships. This book offers a rich anthropological account of Muslim Indonesian women’s experiences of courtship, love, marital discord and separation, polygamy, divorce and remarriage. By applying a new approach to theorising marital experiences as playing out across a dynamic marital continuum, it expands static and dichotomous understandings of marriage and divorce. It offers new insights on how local modalities of Islam shape gender relations and are actively negotiated by women in pursing their marital desires. The book draws upon ethnographic case studies from the eastern Indonesian island of Lombok where early marriage, divorce and remarriage, are common place for Muslim women. In this context up to 70 per cent of marriages are legitimated through Islamic ceremonies and remain unregistered with the state. While these unregistered marriages are legally valid within the communities in which they occur, such unions exclude women from accessing the marital rights theoretically enshrined in Indonesian marriage law. A key contribution of this book lies in its exploration of legal plurality in relation to Indonesian marriage, which involves investigating the salience of Islamic law, local customary law and state law, for women’s varied marital trajectories.

This book is the next volume in Levering's Engaging Doctrine series. The prior volume of the series examined the doctrine of creation. The present volume examines the purpose of creation: the marriage of God and humans. God created the cosmos for the purpose of the marriage of God and his people--and through his people, the marriage of God and the entire creation. Given that the central meaning or "prime analogate" of marriage is the marriage of God and humankind, the study of human marriage needs to be shaped by this eschatological goal and foregrounded as a dogmatic theme. After a first chapter defending and explaining the biblical witness to the marriage of God and his people, the book explores various themes: marriage as an image of God, original sin as the fall of the primordial marriage, the cross of Jesus Christ and marital self-sacrificial love, the procreative and unitive ends of marriage, marriage as a sacrament, and marriage's importance for social justice and for the upbuilding of the kingdom of God. Along the way, the book provides an introduction to the key biblical, patristic, medieval, modern, and contemporary thinkers and controversies regarding the doctrine of marriage.
