Even in secular and civil contexts, marriage retains sacramental connotations. Yet what moral significance does it have? This book examines its morally salient features -- promise, commitment, care, and contract -- with surprising results. In Part One, "De-Moralizing Marriage," essays on promise and commitment argue that we cannot promise to love and so wedding vows are (mostly) failed promises, and that marriage may be a poor commitment strategy. The book contends with the most influential philosophical accounts of the moral value of marriage to argue that marriage has no inherent moral significance. Further, the special value accorded marriage sustains amatonormative discrimination - discrimination against non-amorous or non-exclusive caring relationships such as friendships, adult care networks, polyamorous groups, or urban tribes. The discussion raises issues of independent interest for the moral philosopher such as the possibilities and bounds of interpersonal moral obligations and the nature of commitment. The central argument of Part Two, "Democratizing Marriage," is that liberal reasons for recognizing same-sex marriage also require recognition of groups, polyamorists, polygamists, friends, urban tribes, and adult care networks. Political liberalism requires the disestablishment of monogamous amatonormative marriage. Under the constraints of public reason, a liberal state must refrain from basing law solely on moral or religious doctrines; but only such doctrines could furnish reason for restricting marriage to male-female couples or romantic love dyads. Restrictions on marriage should thus be minimized. But public reason can provide a strong rationale for minimal marriage: care, and social supports for care, are a matter of fundamental justice. Part Two also responds to challenges posed by property division on divorce, polygyny, and supporting parenting, and builds on critiques of marriage drawn from feminism, queer theory, and race theory. It argues, using the example of minimal marriage, for the compatibility of liberalism and feminism.

Against Marriage argues that marriage violates both equality and liberty and should not be recognized by the state. Clare Chambers shows how feminist and liberal principles require creation of a marriage-free state: one in which private marriages, whether religious or secular, would have no legal status. Part One makes the case against marriage. Chambers investigates the critique of marriage that has developed within feminist and liberal theory. Feminists have long argued that state-recognised marriage is a violation of equality. Chambers endorses the feminist view and argues, in contrast to recent egalitarian pro-marriage movements, that same-sex marriage is not enough to make marriage equal. The egalitarian case against marriage is the most fundamental argument of Against Marriage. But Chambers also argues that state-recognised marriage violates liberty, including the political liberal version of liberty that is based on neutrality between conceptions of the good. Part Two sets out the case for the marriage-free state. Chambers criticizes recent arguments that traditional marriage should be replaced with either a reformed version of marriage, such as civil partnership, or a purely contractual model of relationship regulation. She then sets out a new model for the legal regulation of personal relationships. Instead of regulating by status, the state should regulate relationships according to the practices they involve. Instead of regulating relationships holistically, assuming that relationship practices are bundled together in one significant relationship, the marriage-free state regulates practices on a piecemeal basis. The marriage-free state thus employs piecemeal, practice-based regulation. It may regulate private marriages, including religious marriages, so as to protect equality. But it takes no interest in defining or protecting the meaning of marriage.

This book is a defense of political liberalism as a feminist liberalism. The first half of the book develops and defends a novel interpretation of political liberalism. It is argued that political liberals should accept a restrictive account of public reason and that political liberals' account of public justification is superior to the leading alternative, the convergence account of public justification. The view is defended from the charge that such a restrictive account of public reason will unduly threaten or undermine the integrity of some religiously oriented citizens and an account of when political liberals can recognize exemptions, including religious exemptions, from generally applicable laws is offered. In the second half of the book, it is argued that political liberalism's core commitments restrict all reasonable conceptions of justice to those that secure genuine, substantive equality for women and other marginalized groups. Here it is demonstrated how public reason arguments can be used to support law and policy needed to address historical sites of women's subordination in order to advance equality; prostitution, the gendered division of labor and marriage, in particular, are considered.

Saying that political and social oppression is a deeply unjust and widespread condition of life is not a terribly controversial statement. Likewise, theorists of justice frequently consider our obligation to not turn a blind eye to oppression. But what is our culpability in the endurance of oppression? In this book, Mara Marin complicates the primary ways in which we make sense of human and political relationships and our obligations within them. Rather than thinking of relationships in terms of our intentions, Marin thinks of them as open-ended and subject to ongoing commitments. Commitments create open-ended expectations and vulnerabilities on the part of others, and therefore also obligations. By this rationale, our actions sustain oppressive or productive structures in virtue of their cumulative effects, not the intentions of the actors.When we violate our obligations we oppress others. Over the chapters of her book, Marin applies her model of commitment to caregivers, marriage, and bargaining power between labor and employers, and examines three types of social relations: political-legal relations, intimate relations of care, and work relations. By linking habitual action to obligation, Marin argues that we should see our responsibilities within such relationships as political and as creating norms for behavior over time. Commitment both points to the support our actions give to oppressive structures and to the ways in which our actions can weaken the same structures. Connected by Commitment examines our obligations to transform structures of oppression and offers commitment as a model for solidarity across race, gender, and class.

Although the debate over same-sex marriage in the United States has ended, no one seems to know what lies on the horizon. The conversation about what marriage could be like in the future is no longer confined to academics. In his dissent in Obergefell, Chief Justice Roberts linked the constitutionally-mandated legal recognition of same-sex marriage to the possibility that states may also have to recognize multi-person intimate relationships as well to avoid discriminating against plural marriage enthusiasts. The popularity of television shows like TLC’s Sister Wives and HBO’s Big Love suggests that Americans no longer can be dismissive of the possibility that in the foreseeable future, marriage could, and perhaps should, look very different than it does today. Rather than settling the question of whether states ought to abolish marriage, make it more inclusive, contractual, or call it something else, this book exposes readers to some of the normative, legal, and empirical questions that Americans must address before they can deliberate thoughtfully about whether to keep the marital status quo where monogamy remains privileged. Unlike much of the debate over same-sex marriage, they exchange reasons with one another as they discuss marital reform.
