The interest in minority protection emerged during the period of democratic transition, particularly of ethnically segmented postcommunist societies after the end of the Cold War. Minority issues became prominent as postcommunist states lined up as potential candidates for EU membership and the respect for and protection of minority rights was an essential part of criteria these states had to fulfil before EU accession. Minority rights protection has constituted an important ‘gatekeeping’ criterion for EU membership. Its monitoring remains a powerful instrument to mediate tensions and to adjudicate discriminations in the present-day Europe. In many countries, minority rights standards have been transposed in domestic legislation, but whether these norms constitute a legitimate background which states accept, sustain and promote is the focus of this book. This volume takes on the task of analysing the diffusion of minority rights norms across the European continent. It looks specifically at the oft-neglected process of compliance meaning not only the formal adoption of European laws but also their implementation within the domestic context. The world is currently going through an unprecedented era of migration, with tens of millions of people moving to new cities, countries and continents every year. But though the decision to move can be driven by the search for opportunities and a better life, in many cases violence, persecution and other human rights abuses are the primary causes of migration. This is especially the case for minorities and indigenous peoples, who in the context of widespread discrimination can face a distinct experience of migration where their own agency is severely curtailed – one often characterized by further discrimination as entrenched patterns of exclusion are replicated elsewhere. This report, No escape from discrimination: minorities, indigenous peoples and the crisis of displacement, focuses specifically on the situation of minorities and indigenous peoples subjected to this form of forced migration, including its causes, impacts and potential solutions. Though the most direct and visible examples arise from the mass displacement of particular ethnic or religious communities due to sectarian violence, migration of minorities and indigenous peoples can also result from broader factors such as natural disasters or exclusion. In particular, the report focuses on four key areas - conflict, climate change, nationalism and land rights - where forced displacement among minority and indigenous communities is playing a decisive role in their ability to enjoy their most fundamental human rights. The report, while calling for a number of positive steps to protect vulnerable communities and provide the means for safe return or resettlement elsewhere, also highlights how displacement is generally the culmination of a protracted process of exclusion that leaves minorities and indigenous peoples particularly vulnerable to eviction, ethnic cleansing and other abuses. Establishing stronger rights protections for all, including minorities and indigenous peoples, rather than building walls or restricting travel, is therefore the only effective way to respond to the reality of displacement and provide a long-term solution to the crisis currently unfolding for these groups.

We need scarcely note that the topic of this book is the stuff of headlines. Around the world, political, economic, educational, military, religious, and social relations of every variety have a racial or ethnic component. One cannot begin to understand the history or contemporary situation of the United States, the Soviet Union, China, Zimbabwe, South Africa, Great Britain, Lebanon, Mexico, Canada-indeed, almost any land-without careful attention to the influence of cultural and racial divisions. Preparation of this new edition has brought a strong sense of deja vu, with regard both to the persistence of old patterns of discrimination, even if in new guises, and also to the persistence of limited and constraining explanations. We have also found, however, rich new empirical studies, new theoretical perspectives, and greatly expanded activity and analyses from members of minority groups. Although this edition is an extensive revision, with reference both to the data used and the theoretical approaches examined, we have not shifted from our basically analytical perspective.
