This book offers the first comprehensive analysis of medieval Frisian law, focusing on the influence of Roman and canon law in the fourteenth and fifteenth centuries. It makes use of recent translations of Old Frisian legal texts to show the evolution of Frisian law and to unveil why the Frisians were motivated to change their traditional laws. The book covers everything from oaths as evidence in Frisian procedures, to whether Frisian widows could be guardians of their children, to the role the Frisians themselves played in the evolution of their legal system.

Along with most of the rest of Western culture, has crime itself become more "civilized"? This book exposes as myths the beliefs that society has become more violent than it has been in the past and that violence is more likely to occur in cities than in rural areas. The product of years of study by scholars from North America and Europe, The Civilization of Crime shows that, however violent some large cities may be now, both rural and urban communities in Sweden, Holland, England, and other countries were far more violent during the late Middle Ages than any cities are today. Contributors show that the dramatic change is due, in part, to the fact that violence was often tolerated or even accepted as a form of dispute settlement in village-dominated premodern society. Interpersonal violence declined in the seventeenth and eighteenth centuries, as dispute resolution was taken over by courts and other state institutions and the church became increasingly intolerant of it. The book also challenges a number of other historical-sociological theories, among them that contemporary organized crime is new, and addresses continuing debate about the meaning and usefulness of crime statistics. Banishment In The Late Medieval Eastern Netherlands written by Edda Frankot and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-12-07 with History categories.
This open access book analyses the practice of banishment and what it can tell us about the values of late medieval society concerning morally acceptable behaviour. It focuses on the Dutch town of Kampen and considers the exclusion of offenders through banishment and the redemption of individuals after their exile. Banishment was a common punishment in late medieval Europe, especially for sexual offences. In Kampen it was also meted out as a consequence of the non-payment of fines, after which people could arrange repayment schemes which allowed them to return. The books firstly considers the legal context of the practice of banishment, before discussing punishment in Kampen more generally. In the third chapter the legal practice of banishment as a punitive and coercive measure is discussed. The final chapter focuses on the redemption of exiles, either because their punishment was completed, or because they arranged for the payment of outstanding fines.

This book provides a novel approach to the social scientific study of violence. It argues for an 'extended' definition of violence in order to avoid subscribing to commonsensical or state propagated definitions of violence, and pays specific attention to 'autotelic violence' (violence for the sake of itself), as well as to terrorism.

Third Sex Third Gender written by Gilbert Herdt and has been published by Princeton University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-10-27 with History categories.
Most modern discussions of the relationship of biological sex to gender presuppose that there are two genders, male and female, founded on the two biological sexes. But not all cultures share this essentialist assumption, and even Western societies have not always embraced it. Bringing together historical and anthropological studies, Third Sex, Third Gender challenges the usual emphasis on sexual dimorphism and reproduction, providing a unique perspective on the various forms of socialization of people who are neither “male” nor “female.” The existence of a third sex or gender enables us to understand how Byzantine palace eunuchs and Indian hijras met the criteria of special social roles that necessitated practices such as self-castration, and how intimate and forbidden desires were expressed among the Dutch Sodomites in the early modern period, the Sapphists of eighteenth-century England, or the so-called hermaphrodite-homosexuals of nineteenth-century Europe and America. By contextualizing these practices and by allowing these bodies, meanings, and desires to emerge, Third Sex, Third Gender provides a new way to think about sex and gender systems that is crucial to contemporary debates within the social sciences.
