This short academic paper has been prepared as background reading for a training session of mid-level policy makers in the State of Rajasthan in India; and examines the need for efficient, mission-mode public procurement of lighting systems for government and municipal use in the State as a case study. The primary objective is to relate public policy objectives and integrate them with legal requirements imposed by the Rajasthan Transparency in Public Procurement Act 2012 operative in the State, being the only UNCITRAL-like public procurement legislation prevalent in any State in India.

The current universal concerns about global energy security, competitiveness, and environmental protection make energy efficiency more important than ever. However, realizing large-scale savings has proven a significant challenge due to many barriers. 'Public Procurement of Energy Efficiency Services' looks at a largely untapped energy efficiency market the public sector. While the efficiency potential in this sector is substantial, the implementation of energy savings programs has been complicated by a number of factors, such as insufficient incentives to lower energy costs, rigid budgeting and procurement procedures, and limited access to financing. The book looks at energy savings performance contracts (ESPCs) as a means of overcoming some of these barriers. Because public facilities can outsource the full project cycle to a commercial service provider, ESPCs can enable public agencies to solicit technical solutions, mobilize commercial financing, and assign performance risk to third parties, allowing the agency to pay from a project s actual energy savings. The recommendations in this book stem from case studies that identified approaches, models, and specific solutions to ESPC procurement, including budgeting, energy audits, and bid evaluation. Such an approach also offers enormous potential to bundle, finance, and implement energy efficiency projects on a larger scale in the public sector, which can yield further economies of scale. ESPCs can also serve as an attractive element for fiscal stimulus packages and efforts by governments to 'green' their infrastructure, which can create local jobs, reduce future operating costs, and mitigate their carbon footprint. Lower energy bills, in turn, help to create fiscal space in future years to meet other critical investment priorities. Bundled public sector energy efficiency projects can help stimulate local markets for energy efficiency goods and services and 'lead by example', demonstrating good practices and providing models to the private sector.

Effective procurement policies can help governments save considerable amounts of money while also reducing energy consumption. Additionally, private sector companies which purchase large numbers of energy-consuming devices can benefit from procurement policies that minimize life-cycle energy costs. Both public and private procurement programs offer opportunities to generate market-transforming demand for energy efficient appliances and lighting fixtures. In recent years, several governments have implemented policies to procure energy efficient products and services. When deploying these policies, efforts have focused on developing resources for implementation (guidelines, energy efficiency specifications for tenders, life cycle costing tools, training, etc.) rather than defining monitoring systems to track progress against the set objectives. Implementation resources are necessary to make effective policies; however, developing Monitoring and Evaluation (M and E) mechanisms are critical to ensure that the policies are effective. The purpose of this article is to provide policy makers and procurement officials with a preliminary map of existing approaches and key components to monitor Energy Efficient Procurement (EEP) programs in order to contribute to the improvement of their own systems. Case studies are used throughout the paper to illustrate promising approaches to improve the M and E of EEP programs, from the definition of the system or data collection to complementary instruments to improve both the monitoring response and program results.

Energy efficiency has been a federal procurement policy objective since at least 1992, with the origin of the Energy Efficient Product Procurement (EEPP) program within the larger Federal Energy Management Program (FEMP). Today, the EEPP program's mandate is based on requirements that 95% of new contract actions, task orders, and delivery orders for products and services be energy and water efficient, as laid out in Executive Order 13514 in 2009. Facilitating full compliance with EO 13514 presents a significant strategic planning challenge to the FEMP EEPP program, given the size of the federal government, the range of missions of its many agencies, the mix of management approaches for its buildings, and the diverse set of roughly 80 energy efficient products which has been established through preceding legislation and executive orders. The goal of this report is to aid the program in prioritizing its resources by providing an overview of how the purchase of energy-consuming products occurs in today's evolving federal procurement system, as well as identify likely intervention points and compliance review mechanisms. Through a synthesis of the literature on U.S. federal sector procurement and two dozen primary interviews, the report particularly focuses on the importance of price in determining the actor(s) responsible for any given purchase of an energy-consuming product. This identification is important, as the relevant actors are trained and reviewed in different ways that the FEMP EEPP program can prioritize for targeting, based on the decision criteria such as the potential energy savings associated with the actor's purchases or the administrative ease of the intervention.
