Pese a la síntesis del volumen se incluyen numerosas referencias jurisprudenciales y doctrinales que se han relegado a los pies de página, al igual que otras de carácter legislativo que remiten al lector a los textos donde se amplían los temas tratados, sin olvidar el abundante caudal bibliográfico al final de cada capítulo, útil al investigador.

Esta monografía realiza un estudio sobre el derecho de opción a la nacionalidad española establecido en la Disposición Adicional 7a de la Ley de Memoria Histórica 52/2007, de 26 de diciembre, desarrollada por la Instrucción de 4 de noviembre de 2008, atinente al procedimiento de opción, sobre el que incide la Ley de Registro civil de 21 de julio de 2011, que amplía en su disposición final sexta el derecho de opción que podrán ejercitar en este año los nietos de mujeres exiliadas que conservaron su nacionalidad después de contraer matrimonio con un extranjero con posterioridad al 5 de agosto de 1954. El plazo de caducidad de la Disposición Adicional 7a de la Ley de Memoria Histórica, hace necesario analizar los requisitos ajustados a las circunstancias de cada optante, siendo oportuno referirse a las reformas del Código civil de 1982, 1990 y 2002 para entender la exclusión en el progreso hacia el reconocimiento de los descendientes de emigrantes españoles que mantienen identidad con el territorio nacional. Se trata de los nietos de quienes perdieron la ciudadanía española antes de que sus hijos nacieran, los hijos mayores de edad de quienes optaron a la nacionalidad, la obtención de la nacionalidad por el cónyuge o pareja casado con español y los descendientes de mujeres que abandonaron el país antes de 1936. También se detallan casos especiales como el los descendientes del Sahara o los resultantes de ciertos supuestos de reproducción asistida. La autora, María José Cazorla González, Profesora Titular de Derecho civil en la Universidad de Almería, es secretaria del departamento de Derecho privado y coordinadora del programa de doctorado “Marco jurídico de la actividad empresarial”, además de ser la presidenta de la Unidad de Garantía de la Unidad de calidad para la Titulación de Derecho. En su investigación relacionada con la materia objeto de la presente obra, cabe destacar que fue ponente en el I Congreso Internacional Derecho y Ciudadanía Española en el exterior, habiendo publicado Mujer, nacionalidad y ciudadanía. Developing countries lose billions each year through bribery, misappropriation of funds, and other corrupt practices. Much of the proceeds of this corruption find 'safe haven' in the world's financial centers. These criminal flows are a drain on social services and economic development programs, contributing to the impoverishment of the world's poorest countries. Many developing countries have already sought to recover stolen assets. A number of successful high-profile cases with creative international cooperation has demonstrated that asset recovery is possible. However, it is highly complex, involving coordination and collaboration with domestic agencies and ministries in multiple jurisdictions, as well as the capacity to trace and secure assets and pursue various legal options—whether criminal confiscation, non-conviction based confiscation, civil actions, or other alternatives. This process can be overwhelming for even the most experienced practitioners. It is exceptionally difficult for those working in the context of failed states, widespread corruption, or limited resources. With this in mind, the Stolen Asset Recovery (StAR) Initiative has developed and updated this Asset Recovery Handbook: A Guide for Practitioners to assist those grappling with the strategic, organizational, investigative, and legal challenges of recovering stolen assets. A practitioner-led project, the Handbook provides common approaches to recovering stolen assets located in foreign jurisdictions, identifies the challenges that practitioners are likely to encounter, and introduces good practices. It includes examples of tools that can be used by practitioners, such as sample intelligence reports, applications for court orders, and mutual legal assistance requests. StAR—the Stolen Asset Recovery Initiative—is a partnership between the World Bank Group and the United Nations Office on Drugs and Crime that supports international efforts to end safe havens for corrupt funds. StAR works with developing countries and financial centers to prevent the laundering of the proceeds of corruption and to facilitate more systematic and timely return of stolen assets.
