John Addington Symonds escreveu Um Detalhe na Ética Grega em 1873, obra que mais tarde seria apelidada de "história gay". A matéria levantada por esse livro surge do advento da Lei 12.424/11 que em sua estrutura inclui ao sistema legal a modalidade de Usucapião Especial Urbana por abandono ao lar, conhecida como Usucapião Familiar. Levantando disposições sobre a dissolução de vínculos conjugais que outrora já se encontravam devidamente inseridas nos artigos 1.571 e 1.582 do Código Civil Brasileiro e utilizando-se de toda e segmentada doutrina, busca-se apresentar os reflexos da nova lei sobre as dissoluções familiares, dando atenção aos pontos positivos e negativos desses reflexos. Analisando a questão da justiça social na igualdade entre os consortes na função social da posse do bem usucapido, o trabalho levanta o perfil histórico do direito de propriedade e posse ao passar dos tempos até os dias atuais. Justificando a intenção literal do direito de posse ao usucapiente que decide por adquirir a posse por essa nova modalidade de usucapião. Através dessa livro chega-se a demonstrar que o novo instituto mesmo que confuso para alguns juristas, ainda causa no meio jurídico um rebuliço, aguarda-se que à medida que as primeiras decisões judiciais sobre essa temática começarem a ser proferidas possa ser observado o equilíbrio entre a constitucionalidade da Lei e a possível Inconstitucionalidade diante da discussão do elemento culpa no fim da relação a fim de configurar o abandono ao lar e posteriormente à aplicação da nova lei. Esse livro oferece um estudo preliminar do tema que além de abrangente é empolgante, que o texto alcance o leitor com a mesma emoção que me alcançou desde o momento que decidir escreve-lo.
