Marietta Auer zeigt, dass die Entwicklung des modernen Privatrechts durch die bekannte Transformationslegende vom angeblich "liberalen" Privatrechtsmodell des 19. Das Selbstverständnis des demokratischen Rechtsstaates ist durch ein facettenreiches Spannungsverhältnis von Moral und Recht geprägt. So bindet etwa das Grundgesetz mit der Verpflichtung zur Achtung und zum Schutz der Würde des Menschen wie auch mit dem Bekenntnis zu”unverletzlichen und unveräußerlichen“Menschenrechten alles staatliche Handeln an zentrale Postulate einer universalistischen Moral. Wenn Menschenwürde keiner noch so mehrheitlichen Meinung zur Disposition stehen dürfen, müssen sie dem politischen Streit entzogen sein. Diesem konstitutionalistischen Verständnis des Rechtsstaates scheint ein radikaldemokratisches Modell der Republik entgegenzustehen, nach dem eine politisch autonome Gesellschaft allein vermittels Gesetzen auf sich einwirkt, die aus Verfahren chancengleicher Teilnahme an politischer Willensbildung hervorgehen. Nach diesem Modell kann es keine außerpolitische Quelle rechtlicher Legitimität geben. Doch was bedeutet es für den Legitimitätsanspruch des demokratischen Rechtsstaates, wenn er gar nicht allen von der Herrschaft : etroffenen9 jene Rechte gleichumfänglich gewähren kann, die politische Autonomie konstituieren? Wie verträgt sich der idealisierte Gedanke einer vollständig inklusiven politischen Selbstbestimmung (Habermas) mit dem faktisch unausweichlichen Umstand, dass die Mehrheit der Rechtsadressaten immer einer Minderheit von Autoren gegenübersteht? Muss nicht jede realistische demokratische Lösung des juridischen Legitimationsproblems hinter dem kategorischen Anspruch zurückbleiben, den unverzagte Moraltheoretiker im Anschluss an Kant für das Menschenrecht reklamieren? Welche normative Rolle spielt dann der Begriff der Menschenwürde im diskurspragmatisch entschlüsselten Spannungsfeld von Moral und demokratisch erzeugtem Recht?

From the beginning of 2000, with the increase and diffusion of modern technologies, a new form of bullying using electronic means has emerged. Literature has reached some consistent findings on the description of the problem. However, there is still a lack of knowledge about developmental processes of cyberbullying and about possible predictors and correlates. Some of the main emerging areas investigated in connection with cyberbullying are: personality factors, callous unemotional traits and self-control, memory cognitive distortions, emotional and moral mechanisms, ICT use and media exposure, family and social contexts. Another important issue is the relation between cyberbullying and face to face bullying. From face to face literature we know some of the mechanisms in the peer group such as the relation between bullying, dominance and popularity and the role of bystanders in the social dynamic of the attacks. However, nothing is known about the cyber community. Contributors to this volume attempt to investigate these group mechanisms in the cyber community. Finally, for the victims, long-term consequences are also relevant, both in terms of perceived stress level and of the association between cyber-victimization and mental health. This special issue offers important new findings on the development and consequences of cyberbullying and cyber-victimization, and opens new and future directions of research.

Der Band versammelt bisher verstreute Aufsätze von Günter Dux zur Geschichte des Geistes und des Subjekts. Sie sollen, das ist die Intention des Bandes, einer Entwicklung zugerechnet werden, von der Dux sagt, dass sie eine Logik aufweise. Als Geist versteht Dux, anders als in aller Vergangenheit, nicht ein Vermögen, das in einem Absoluten am Grunde der Welt oder des Subjekts gelegen ist, als Geist versteht Dux vielmehr ein Vermögen, das sich in Evolution und Geschichte durch den Menschen in medial geschaffenen Formen gebildet hat. Im soziologischen Verständnis hat sich die Geistigkeit an der Welt gebildet, in der Interaktion mit der Welt hat sie sich auch historisch entwickelt. Es hängt doch, sagt Dux, alles am Verständnis der Welt. Die Welt aber ist in der Moderne dadurch zu einer säkular verstandenen Welt geworden, dass jede Epoche Bedingungen geschaffen hat, um über sie hinauszugehen und sich der Prozessualität der Welt umfänglicher zu bemächtigen. Exakt dadurch weist die Geschichte einen Zeitpfeil auf. Der wird von keinem Absoluten und auch nicht intentional bestimmt, sondern von einer prozessualen Logik, durch die sich die Geschichte insgesamt als Prozess der Säkularisation darstellt.
