Major Tony Pfaff, a former Assistant Professor of Philosophy at the United States Military Academy, addresses an important source of much of the confusion that currently surrounds many of the Operations Other Than War (OOTW) that the military finds itself participating in with increasing frequency. The author points out that, though the source of this confusion is primarily ethical, it has important operational implications as well. In the Just War Tradition, as well as the Law of War, there has always been a tension between winning and fighting well, and the peacekeeping environment does not change this. Commonly, the resolution of this tension is expressed in the maxim: always use the least amount of force necessary to achieve the military objective. This maxim applies, regardless of what environment one is in. The author's contention is, however, that the understanding of necessary is radically different in the peacekeeping environment than it is in more conventional operations. Failure to understand this results in a great deal of confusion as soldiers try to apply an ethic designed for dealing with enemies in environments where there are none.

Others have intuitively grasped this point. At the International Military Ethics Symposium in Trondheim, Norway, for example, the Judge Advocate General for the Norwegian Army claimed that the police ethical doctrine is the most appropriate one for peacekeeping missions. He did not, however, explain why. By comparing and contrasting military and police ethics with the range of environments in which soldiers find themselves, the author tries to fill this void by first demonstrating that the Just War Tradition, as generally understood, cannot extend to peacekeeping operations. The author then discusses what must be done to solve this problem and, by so doing, resolve much of the confusion generated when soldiers look like policemen on the outside but have to think like soldiers on the inside. Thus, this monograph should be of great interest not only to those in the field who are routinely confronted with the ambiguities of the peacekeeping environment, but also to those charged with forming the policies that those in the field must observe. This monograph is being published in cooperation with the Center for the Professional Military Ethic to enhance discussion of military professionalism within the Army and sister services.

Peacekeeping is an American value based on the virtues that have made us a great nation and a world super power. Perhaps the only hegemon for the next 20 to 30 years. In order to determine a viable and strategic policy for the United States of America in regards to peacekeeping efforts as a superpower, this research paper employed a critical analysis methodology. This study investigates the issue of peacekeeping and makes recommendations concerning America's involvement and reasons for being fully engaged in efforts to bring peace to a troubled world. The research sought to determine the various reasons for making peacekeeping a central American foreign policy and why historically America has sought peace for itself and the world. Some reasons are: (1) American virtues; (2) America's historical interest in peace; (3) American role as only superpower; and (4) America's religious beliefs and their role in shaping our national interests. The key findings in this research project reveal the following. (1) America has always had an idealistic approach to its relationships with other countries in terms of America's central and key position in the world. (2) America has gone to war many times to restore and preserve freedom and bring peace to a troubled world. (3) America is now the only world superpower which brings certain obligations as well as rights. (4) America is a religious country with all of the values and virtues of a spiritual nation. These virtues and values lead our nation to want good for ourselves and for others.

During the Cold War - an era in which the term ‘asymmetric warfare’ was not well known - the issue of the laws and ethics of war seemed simple enough to most soldiers, being concerned mainly with leadership, management, and morale. Post-Cold War reality revealed a very different set of challenges, including a significantly wider moral dimension, particularly when forces, initially under UN leadership and later under the NATO flag, were deployed in different parts of the turbulent Balkans. Military observers, by now with legal advisers close by, watched events in the Balkans, East Timor and then in central and West Africa with professional interest, and some were involved there. A few years later, soldiers were subsequently caught as much by surprise by the events of 9/11, a graphic example of asymmetric warfare, as most of the rest of the world. The initial, post 9/11 response in Afghanistan and Iraq brought the notion of the fragile or collapsed state, and the blurring of the roles of military forces, international organisations, non-governmental organisations, non-state actors, and indigenous administrators and their uniformed organisations, and with them the moral dilemmas, to much wider notice. More recent conflicts have indeed shown the need for commanders and soldiers in all types of conflict to have a much better understanding of the complex moral and legal environments, and opened new debates about the principle of ‘winning hearts and minds’ in counter-insurgency and peace support operations. Moreover, technological superiority by the West has also produced mixed benefits in the field of military operations, and posed additional dilemmas, many of them moral. The trend towards defining human rights and ‘fundamental freedoms’ poses further questions for the soldier today. This collection of essays, written by a wide variety of practising experts and scholars, touches on all these issues. It links the medieval traditions of jus in bello, codified by Saint Thomas Aquinas in the Christian Church nearly eight centuries ago, to examination of modern challenges and moral dilemmas relating to the ethics and laws of conflict and crises of all types in the twenty-first century, and in a global context among people of many different faiths and beliefs, and none. It is an important collection for all those researching or practically involved in conflict and post-conflict situations.
