O presente livro pretende verificar a possibilidade do reconhecimento e concessão do direito à licença-maternidade para casais homoafetivos do sexo feminino, à luz do paradigma pós-positivista proposto pela Teoria Estruturante do Direito, de F. Müller. A interpretação e aplicação arbitrária e casuística oferecida pelo modelo positivista não possibilita avaliar, com clareza e transparência, os valores que constituem a decisão, fragilizando o controle judicial e social. Na sistematização proposta, espera-se afastar os desafios do modelo atual e assegurar a unidade e coesão dos direitos e princípios fundamentais da Constituição, de 1988. O direito à licença-maternidade foi analisado mediante os elementos que estruturam a norma jurídica: programa normativo e âmbito normativo. Os princípios e direitos fundamentais do texto constitucional, a doutrina de Direito de Família e de Direito Constitucional e a jurisprudência do Supremo Tribunal Federal contribuíram para a elaboração do programa da norma. O âmbito da norma foi elaborado a partir de bases empíricas que englobam os direitos das mulheres, das crianças e da família homoafetiva do sexo feminino e o vínculo materno formado entre eles. Ao final, chega-se à conclusão da necessidade de reconhecer e conceder a licença-maternidade às mulheres que compõem uma relação homoafetiva, à luz da dignidade da pessoa humana, das liberdades individuais, da igualdade, da maternidade e do melhor interesse da criança e do adolescente.

The concept of reproductive health promises to play a crucial role in improving women's health and rights around the world. Reproductive Health and Human Rights is designed to equip healthcare providers and administrators to integrate ethical, legal, and human rights principles in protection and promotion of reproductive health, and to inform lawyers and women's health advocates about aspects of medicine and healthcare systems that affect reproduction. Rebecca Cook, Bernard Dickens, and Mahmoud Fathalla, leading international authorities on reproductive medicine, human rights, medical law, and bioethics, integrate their disciplines to provide an accessible but comprehensive introduction to reproductive and sexual health. They analyse fifteen case-studies of recurrent problems, focusing particularly on resource-poor settings. Approaches to resolution are considered at clinical and health system levels.
