New realities in US higher education present a multifaceted crisis for students, faculty, administrators, and society at-large. In this original and practical book, Naomi Zack provides incisive diagnoses of pressing problems and prescriptions to reinstate and support US higher education as an intellectually and ethically valuable institution. Among the problems addressed in this open access book are the US Supreme Court ban of affirmative action; falling enrollment and low retention; downsized and defunded humanities; the unjust situation of adjunct instructors; college firsts confronting social class; student mental health and microaggressions; disruptive free speech; the mind-numbing effects of AI; campus dangers and insecurity; and anti-intellectual ideological political pressure. The new ideas and policy changes proposed here result in a new model of belonging for the multiplicities of race, ethnicity, gender, class, age, and nationality––and more––in current and future college communities. The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com. Open access was funded by Lehman College, CUNY.

For more than a century academics have had unique rights not enjoyed by other citizens -- to speak, teach, and write freely. Central to the case for academic freedom is that scholars must be able to voice their views free of fear in order for society to gain a better understanding of ourselves and our world. Academic freedom has always faced challenges. Professors have been pressed to alter their work because it offends powerful interests -- both inside and outside the university. Some have been fired or denied jobs for their political views, their criticisms of colleagues and administrators, and their refusal to buckle under corporate pressures to hush up research findings. The sixteen contributors to this volume cite many such instances in Canada and the U.S. More significantly, they point out how governments, corporations, and university administrators today are seeking to narrow academic freedom. Among them: Major donors are acquiring control over university teaching and even hiring decisions University administrators are firing professors with unpopular political views, while pretending that the reasons for their decisions lie elsewhere Governments are using funding mechanisms to force-feed research in some areas, while shutting down inquiry in others Campus-wide policies enforcing civility rules are preventing criticism and debate within a university Judges are issuing decisions which reverse previous rulings supporting academic freedom in the U.S. and Canada Together the contributors to this book document the many arenas in which academic freedom is in jeopardy and explore its legitimate limits.

What was once the factory is now the university. We started off with this apparently straightforward affirmation, not in order to assume it but to question it; to open it, radically rethinking it, towards theoretical and political research. University corporatization and the rise of a global university are not unilateral impositions or developments completely contained by capitalist rationality. Rather they are the result--absolutely temporary and thus reversible--of a formidable cycle of struggles. The problem is to transform the field of tension delineated by the processes analyzed in this book into specific forms of resistance and the organization of escape routes. This is Edu-factory's starting point and objective, its style and its method.

Of the American Bill of Rights, perhaps the forty-five words that comprise the First Amendment-allowing freedom of religion, speech, press, and assembly, and the guaranty of the writ of habeas corpus-are the most precious. Only a legal expert could lay claim to truly understanding the meaning and intention of those basic freedoms. Yet it is precisely the expert, knowing the complexity of the subject, who would be the first to hesitate to claim to possess such a thorough understanding. In analyzing such freedoms basic to American society, Milton Konvitz helps make comprehending our fundamental liberties easier. The book is divided into three parts: I. Freedom of Religion; II. Freedom of Speech, Press, and Assembly; III. Freedom of Speech, Press, and Assembly: The Clear and Present Danger Doctrine. The reader will find included such topics as the debate over the scope of the separation of Church and State, whether or not freedom of religion is an absolute right, religious freedom prior to 1776, the liberty of private schools, heresy, the right for a religious group to seek converts, the freedoms not to speak and listen, obscene literature, picketing in labor disputes, the freedom to think and believe, abridgments of speech and press, and loyalty oaths and guilt by association. Konvitz's work includes an important chapter on the history of the adoption of the Bill of Rights. His careful tracing of the development of constitutional attitudes to the freedoms protected by the First Amendment is a scholarly benchmark, and is still an archetype for students doing research and writing about these issues. It is of critical importance to anyone seeking an authoritative statement on the basic liberties guaranteed by the First Amendment to the United States Constitution. Fundamental Liberties of a Free People is a relevant and practical guide to understanding the liberties so fundamental to a free society. In his new introduction and afterword, author Milton Konvitz brings First Amendment developments up to 2002. It will be welcomed by students and scholars of constitutional law, government, politics, religion, and American history.
