This title was first published in 2000: One of the most significant features to emerge in the world of work during the past decade has been the change from long-term employment, often with one employer, to a pattern of short-term, flexible working arrangements involving short-term contracts, frequent spells of unemployment, rapid movement into and out of employment and greater labour mobility. This text examines the social and economic consequences of this employment flexibility. The book derives from the 2nd Anglo-French Conference on the Transferability of Social Policy held in 1998, which focused on the problems created by employment flexibility and the appropriate policy responses, it also presents commentaries on the consequences of flexibility in Britain and France. Le contrat de travail à temps plein et à durée indéterminée est censé être le contrat « standard » gouvernant les relations entre employeurs et salariés. Protecteur des intérêts du salarié, cette forme d’emploi peut se heurter au souhait des entreprises de disposer d’une main-d’œuvre flexible qui s’adapte aux fluctuations de la demande et aux changements technologiques. Les statistiques montrent qu’au Luxembourg, les formes flexibles et atypiques de travail restent en-deçà de la moyenne européenne, mais que leur taux est en augmentation. Le contrat à durée indéterminée en soi offre une certaine flexibilité dite ‘interne’ au niveau de la durée, de l’horaire, du lieu, des fonctions, de la rémunération ou encore de la résiliation pour motif économique. Pour mieux maîtriser les effectifs de l’entreprise (flexibilité externe), l’entreprise peut avoir recours à des formes précaires d’emploi, tels que le contrat à durée déterminée, le travail intérimaire et les diverses formes de contrats d’insertion, qui sont strictement encadrées par le Code du travail. En dehors d’un cadre légal précis se développent par ailleurs d’autres formes de travail flexibles, tels que la fausse indépendance, les contrats dits « zéro heures », le travail intermittent, le portage salarial, les Minijobs ; encore peu présents au Luxembourg, ces contrats connaissant une progression remarquable dans nos pays voisins. Cette problématique très actuelle n’a pas encore fait l’objet d’analyses juridiques détaillées en droit luxembourgeois. Pour cette raison, l’auteur a décidé de se pencher sur les réponses que notre droit social apporte actuellement et pourrait apporter à l’avenir à l’encadrement des relations d’emploi pour trouver un équilibre entre la sécurité recherchée par les salariés et la flexibilité souhaitée par les employeurs.
