This book deals with human rights action planning, as a largely under-researched area, from theoretical, doctrinal, empirical, and practical perspectives, and as such, provides the most comprehensive studies of human rights planning to date. At the theoretical level, by advancing a novel general theory of human rights planning, it offers an alternative to the traditional state-centric model of planning. This new theory contains four sub-theories: contextual, substantive, procedural, and analytical ones. At the doctrinal level, by conducting a textual analysis of core human rights conventions, it reveals the scope and nature of the states' obligation to adopt a plan of action for implementing human rights. At the empirical level, a cross-case analysis of national human rights action plans of 53 countries is conducted exploring the major problems of these plans in different phases of planning and uncovering the underlying causes of these problems. At the practical level, this volume sets out how these plans should be developed and implemented, how they can be best monitored by international human rights bodies, and how to maximize their effectiveness. With discussions bridging human rights theory and practice and development discourse, this book will be a useful resource for a wide range of audiences, from academics of different disciplines (law, human rights, social policy, political science, political philosophy, legal philosophy, development studies, planning studies, socio-legal studies) to governments, human rights practitioners, and the UN human rights bodies.

The human rights movement strives to develop a universal culture of human rights in all societies, as well as to confront gross violations. This book, the first ever of its kind, is a veritable State of the World Report on Human Rights. It reproduces summaries by UN High Commissioners for Human Rights on the state of the national human rights protection systems of each UN Member State. These summaries were sent following each state’s passage through the Universal Periodic Review (UPR) process of the UN Human Rights Council. The summaries identify each state’s constitutional, legal, judicial and institutional architecture, international conventions not yet ratified, areas of progress, problem areas, and problems affecting different parts of the population. The High Commissioners’ summaries reproduced here are preceded by insightful reflections on the concept of a national human rights protection system, and by regional outlines of national human rights protection systems in the Americas and the Caribbean, Europe Africa, Asia and the Pacific. The book also contains some case studies of the national human rights protection systems of sample states such as Australia, Bhutan, Brazil, Canada, Democratic Republic of the Congo, Guyana, Portugal, Switzerland, Sweden, and South Africa.

Commonwealth Model National Plan Of Action On Human Rights written by Commonwealth Secretariat and has been published by Commonwealth Secretariat this book supported file pdf, txt, epub, kindle and other format this book has been release on 2007 with Law categories.

While many countries seek to improve their capacity to protect and promote human rights in accordance with constitutional imperatives and Commonwealth values, they often lack a clear roadmap on how to do so. Currently, there is no single and easy-to-use model which Commonwealth countries can use as a basis for planning the process. This guide will particularly useful for those in smaller countries who wish to develop a human rights plan. The action plan makes three key points: first that full public participation in the development of a national action plan is key to a successful outcome, secondly that putting the plan into operation need not mean adding another bureaucratic layer to government, and thirdly that the model is a model only, and not intended to be prescriptive.

"In April 2009, the Chinese government unveiled its first-ever National Human Rights Action Plan (NHRAP). Adoption of the NHRAP was a welcome development, suggesting greater Chinese government commitment to the rights embodied in China's laws and constitution and the Universal Declaration of Human Rights. During the two-year term of the NHRAP, which ended in December 2010, the Chinese government continued its policy of prioritizing the rights of 'subsistence and development' over civil and political rights. The United Nations praised China's successes in delivering on some of those economic and social rights, particularly in the areas of poverty alleviation. While the Chinese government promoted the potential of the NHRAP to address serious human rights deficiencies, it simultaneously tightened restrictions on rights to expression, association, and assembly. Abuses included the sentencing of high-profile dissidents such as Nobel Peace Prize laureate Liu Xiaobo to lengthy prison terms on spurious state secrets or 'subversion' charges, expanded restrictions on media and internet freedom, as well as tightened controls on lawyers, human rights defenders, and nongovernmental organizations. During the NHRAP period, the Chinese government broadened controls on Uighurs and Tibetans, and engaged in widespread enforced disappearances and arbitrary detentions, including in secret, unlawful detention facilities known as 'black jails.' Promises Unfulfilled details that rollback of key civil and political rights and how those limitations enabled--rather than reduced--a host of human rights abuses specifically targeted in the NHRAP. The report also provides recommendations for how the Chinese government can make meaningful improvements in its approach to human rights in 2011."--P. [4] of cover.
