This book offers a fresh perspective on the Habitats Directive's rules on designating Natura 2000 - the European biodiversity conservation network. Although the Habitats Directive came into force in the early 1990s, the network is not yet optimally set up and lacks coherence and connectivity. The author examines the Habitats Directive’s provisions regarding the designation of Natura 2000 and discusses possible reasons for the EU Member States’ ongoing lack of compliance with their designation duties. She reassesses the 2015 REFIT Fitness Check of the Nature Directives to look for the Member States’ reasons for not having optimally complied with their designation duties yet. She then analyses the Habitats Directive to reveal elements of non-optimal drafting in its designation provisions. Sensible law reforms that do not interfere with the general framework of the Habitats Directive and which keep in mind the relevant national, regional, and international biodiversity law and policy,as well as the relevant case law will be discussed to this end. As a result, this book presents an enhanced legal designation framework that can support Member States’ compliance with their designation obligations. The book finally goes beyond the European biodiversity legislation, also shedding light on the effects of the suggested reforms for the broader biodiversity and environmental law and policy landscape, and concludes that reforming the Habitats Directive would benefit a variety of contemporary areas of law. This book targets academics and policy-makers in the field as it provides a scholarly as well as a hands-on approach to the subject of strengthening European biodiversity law.

This volume offers insight in the identification and selection procedure of marine protected areas in the German exclusive economic zones (EEZs) of the North - and Baltic Seas. EU Member States are obliged to establish a coherent network of protected areas, consisting of sites identified under the EC Habitats and Birds Directives. The goal of this Natura 2000 network is the conservation of biodiversity on land and in the sea. To fill important gaps in knowledge regarding the presence, abundance, and distribution of certain species and habitats in the German North- and Baltic Seas, the German Federal Agency for Nature Conservation (BfN) initiated a detailed research programme, involving researchers from many renowned German marine research institutes. This book contains the main results of the different projects under this research programme, which formed the basis for the identification and selection of the Natura 2000 sites. Information is given on two NATURA 2000 habitats (sandbanks and reefs), and benthic species, fish, birds and marine mammals, as well as on legal aspects and implementation procedures. Last but not least the book introduces the current status of NATURA 2000 in the German EEZ. Target audience are not only scientists, but also policymakers, environmental organisations and other stakeholders, and the book includes many illustrations.

The pace of biodiversity decline is quickening worldwide. Habitat break-up, pollution, over-use of natural areas and the creation of artificial landscapes increase the rate of erosion, while reducing species' opportunity for migration, dispersion and exchange. In 1995, when the European Ministers of the Environment met in Sofia, they launched the Pan-European Biological and Landscape Diversity Strategy, so as to strengthen environment and biodiversity conservation policies. The setting up of the Pan-European Ecological Network covering Eurasia was one of the key steps taken under the Strategy. Work has continued on this project, and it is now based on the numerous national, regional and transregional ecological networks being set up throughout Europe.In Kiev, in 2003, the Ministers and heads of delegation noted these positive developments, expressed firm support for the creation of the Pan-European Ecological Network and asked for its constituent parts to be identified and mapped on a pan-European scale.This book looks at the implementation of this Network in the 55 states concerned. It has been written by a team comprising, under the aegis of the Council of Europe, numerous government experts and specialists dealing with the issue of ecological networks. It is intended to reassure Ministers, policy-makers and scientists that they made the right decision in supporting the creation of the Pan-European Ecological Network with a view to (re-)creating a true green infrastructure for Europe.

This book analyses the Habitats Directive; one of the most prominent piece of EU environmental legislation of the past decades. The Natura 2000 network of protected areas is the centrepiece of European Union nature policy, currently covering almost one-fifth of the EU’s entire land territory plus large marine areas. This vast EU-wide network, which aims to conserve Europe’s most valuable and threatened species and habitats, has major impacts on land use throughout all Member States of the EU. This book critically assesses the origins and implementation of the Natura 2000 network, established under the Birds Directive of 1979 and the Habitats Directive of 1992. Based on original archival research and interviews with key participants, the book records a detailed history of the origins and negotiation of Natura 2000 policy and law, with the history of EU environmental policy provided as a framework. An historical institutionalist approach is adopted, which emphasises the importance of understanding legal and policy development as processes that unfold over time. Three phases in the history of EU environmental policy are identified and described, and the history of EU nature policy is placed within the context of these three phases. Informed by this history, the author presents a comprehensive summary and assessment of the law and policy that protects Natura 2000 sites at EU level, and reviews the nature conservation outcomes for the targeted species and habitats. The book reveals how a knowledge of the history of Natura 2000 enriches our understanding of key issues such as conflicts in establishing and conserving the Natura 2000 network, EU integration in the field of nature conservation, and the future of EU nature policy.
