In 1985 werd de Nederlandse Raad voor Juridische Samenwerking met Indonesië opgericht. De Raad gaf aan de ontsluiting van Indonesische rechtsbronnen hoge prioriteit. Plannen hiertoe waren inmiddels ontwikkeld door het Van Vollenhoven Instituut voor Recht en Bestuur in Niet-Westerse Landen van de Rijksuniversiteit te Leiden. Dit project voorzag in het opbouwen van een databestand van juridische artikelen en jurisprudentie uit Nederlands-Indië vanaf de invoering van de codificatie en de reorganisatie van het rechtswezen in 1848 tot aan de overdracht van de souvereiniteit aan het in 1949 onafhankelijk geworden Indonesië met een uitloop in de jaren vijftig. Het Indisch Tijdschrift van het Recht en de Mededelingen van het Documentatiebureau voor Overzees Recht vormden de bronnen van het databestand. Het Indisch Tijdschrift van het Recht omdat het het langst verschenen (1849-1950) en meest gezaghebbende juridische periodiek van Nederlands-Indië was, de Mededelingen omdat het veel belangrijk materiaal uit de periode 1950-1958 bevat. Het databestand diende als basis voor dit register. Het doel ervan is het vergroten van de toegankelijkheid van de Nederlands-Indische jurisprudentie, in Indonesië allereerst ten behoeve van de rechtsontwikkeling en rechtspraktijk, in Nederland ten behoeve van onderzoek en onderwijs. In dit register zijn 1515 geannoteerde rechterlijke uitspraken beschreven. Deze zijn systematisch ingedeeld en daarna chronologisch geplaatst. Vier registers bieden extra zoekingangen, te weten één register op annotatoren, één op trefwoorden, één op relevanle wetsartikelen en één op rechterlijke instanties. Voor Indonesisch- en Engelstalige gebruikers zijn vertalingen van de vele Nederlandse rechtskundige termen, gebruikt in het trefwoordenregister, opgenomen.

In Recht en rechtspraak in Nederlands-Indië wordt een overzicht verschaft van het ingewikkelde rechtsstelsel van Nederlands-Indië, zoals dat van 1848 tot 1950 functioneerde, en dat voor een groot deel is overgenomen door de Republiek Indonesia. Tot nu toe bestond zo'n beknopt overzicht niet. Het is bedoeld voor hen, die voor het eerst kennis maken met het recht van Nederlands-Indië en behoefte hebben aan een overzicht van de hoofdlijnen van het stelsel en de belangrijkste rechterlijke instellingen. Het is geschreven voor (rechts) historici, antropologen en andere geïnteresseerden in het Nederlands-Indische rechtsstelsel. Recht en rechtspraak in Nederlands-Indië is een bewerking van een inleiding geschreven voor het boek Nederlands-Indische jurisprudentie: Register op de geannoteerde rechtspraak in het "Indisch Tijdschrift van het Recht" (1949-1950) en de "Mededelingen van het Documentatiebureau voor Overzees Recht" (1950-1958). Dit boekje kwam tot stand naar aanleiding van een opdracht voor een documentatieproject dat voor de Nederlandse Raad voor Juridische Samenwerking met Indonesië te Leiden werd uitgevoerd door het Van Vollenhoven Instituut van Rijksuniversiteit te Leiden.

In 1991 Indonesia introduced a system of administrative courts that was to contribute to establishing the rule of law in Indonesia and to provide recourse for citizens against unlawful administrative behaviour. This book evaluates the performance of the administrative court system. It explains why the courts were established in spite of the Indonesian state's authoritarian nature, and why and to what extent the system is a Dutch legal transplant. It analyses the jurisdictionary powers of the courts and how the courts have used them. It then proceeds to explain the unbalanced nature of the record presented, by analysing factors inside and outside the administrative court organisation which influence its performance. These include budgetary deficits, lack of training opportunities, career manipulation, corruption, lack of government support, and many other non-legal issues. Finally, the author provides a number of recommendations for change, many of which may also be of use to other developing countries.

In the literature on Indonesian legal history, the role of language has been paid scant attention. Even the replacement of Dutch by Indonesian as the official language of the law, surely a major event for the work of Indonesian jurists, has not been closely examined. Yet, since the early 1970s, legal usage and terminology have been the topic of a steady stream of highly critical publications by linguists and, remarkably, by jurists as well. Their criticism is focused on the heterogeneity of law language and terminology, and the deviation of legal usage from the official standard language. Government measures (language courses, law dictionaries) have not allayed this criticism. This study exposes two fundamental defects in the government measures and in the criticism itself. Firstly, they are grounded in an instrumental approach to language, an approach that sees language as a mere tool of the jurist, and as secondary in importance to the conceptual world that is considered law’s core business. Secondly, they greatly underestimate the impact of the declining knowledge of Dutch upon the development of Indonesian law language. Massier argues that the law must be viewed as inextricably bound up with the language in which it is formulated. Consequently, legal training and practice are examined in this study in terms of language behaviour and conventions, of learning, writing and speaking the languages of the law. The voice of the law in transition provides a language history of Indonesian law and its practitioners.

Jakarta, Sambas, Poso, the Moluccas, West Papua. These simple, geographical names have recently obtained strong associations with mass killing, just as Aceh and East Timor, where large-scale violence has flared up again. Lethal incidents between adjacent villages, or between a petty criminal and the crowd, take place throughout Indonesia. Indonesia is a violent country. Many Indonesia-watchers, both scholars and journalists, explain the violence in terms of the loss of the monopoly on the means of violence by the state since the beginning of the Reformasi in 1998. Others point at the omnipresent remnants of the New Order state (1966-1998), former President Suharto's clan or the army in particular, as the evil genius behind the present bloodshed. The authors in this volume try to explain violence in Indonesia by looking at it in historical perspective.
