Studienarbeit aus dem Jahr 2016 im Fachbereich Philosophie - Praktische (Ethik, Ästhetik, Kultur, Natur, Recht, ...), , Sprache: Deutsch, Abstract: Wie nah oder fern Arendts Freiheitsauffassung den von Berlin aufgestellten Freiheitskonzeptionen ist, darum soll es unter anderem in dieser Arbeit gehen. So geht sie der Frage nach: In welchem Verhältnis steht Arendts Freiheitsbegriff zu den Konzeptionen negativer und positiver Freiheit von Isaiah Berlin, inwiefern gibt es Unterschiede und Gemeinsamkeiten und inwieweit lässt sich daraus eine Kritik Arendts am Liberalismus erkennen? Zuerst werden im zweiten Kapitel die zwei Freiheitskonzeptionen Berlins der „negativen“ und „positiven“ Freiheit beschrieben, wie er sie in seiner Vorlesung „Two Concepts of Liberty“ formuliert hat (Berlin 1998). Das dritte Kapitel widmet sich dem Freiheitsbegriff von Hannah Arendt, hauptsächlich entwickelt aus ihrem Aufsatz „Freiheit und Politik“ sowie aus Stellen der Bücher „Was ist Politik?“, „Über die Revolution“ und „Vita Activa.“. Im vierten Kapitel folgt dann der Analyseteil, in dem vergleichend auf das Menschenbild Arendts und Berlins (4.1) sowie auf Gemeinsamkeiten (4.2) und Unterschiede (4.3) der Freiheitsauffassungen eingegangen wird. Daneben wird im fünften Kapitel eine mögliche Kritik Arendts an liberalen Vorstellungen Berlins formuliert, basierend auf einem Aufsatz von Rahel Jaeggi, der Arendts Kritik am Liberalismus behandelt (vgl. Jaeggi 2003). Zum Schluss das Fazit.

Kant’s theory of practical freedom represents a masterpiece of the philosophical inquiry into self-constitution, self-government, and volitional self-determination. It includes a sophisticated theory of action intrinsically determined by a specific concept of control over the processes that determine the contents of volition as well as those which facilitate the realization of ends. English summary: As far as constitutional law is concerned, the welfare state is a vague phenomenon and is generally ignored in the current theory of constitutional law. There are however good reasons for maintaining that the welfare state as described in the German Basic Law is primarily supposed to be conducive to ensuring the minimum prerequisites for a self-determined life. Hans Michael Heinig shows that the establishment of equality, solidarity, social justice and security take secondary importance as constitutional goals. If the main function of the social welfare state is to serve freedom, its theoretical and dogmatic shape becomes clear, since this function is, according to the constitution, the reason for and the limits to the welfare state. Those questions regarding fundamental social rights or constitutional claims to the minimum requirements in order to meet essential needs will be answered just as well as those questions pertaining to the limits to redistribution in the welfare state. German description: Das Sozialstaatsprinzip findet in der gegenwartigen Staatsrechtslehre kaum Beachtung. Der Sozialstaat gilt verfassungsrechtlich als diffuses Phanomen. Teils wird der Rechtscharakter der Formel vom sozialen Staat generell bestritten, teils wird ihr kein materieller Inhalt zugesprochen, sondern ihre Ausfullung pauschal dem Gesetzgeber uberlassen. Dabei bedarf die Praxis des Sozialstaates durchaus der verfassungsrechtlichen Anleitung.Hans Michael Heinig veranschaulicht gute Grunde dafur, dass der Sozialstaat des Grundgesetzes normativ zuvorderst der Sicherstellung von Mindestbedingungen fur ein selbstbestimmtes Leben dienen soll. Er zeigt auf, dass die Herstellung von Gleichheit, Solidaritat, Gerechtigkeit und Sicherheit demgegenuber als verfassungsrechtliche Primarziele zurucktreten. Auf diese Weise von seinem Dienst an der Freiheit her begriffen, gewinnt der soziale Staat theoretisch wie dogmatisch Konturen: Die Freiheitsfunktionalitat bildet von Verfassungs wegen Grund wie Grenze des Sozialstaates. Freiheit meint dabei sowohl die individuelle Selbstbestimmung wie die Teilhabe an der demokratischen Selbstregierung. Hieraus entsteht ein spannungsvolles Wechselspiel zwischen Freiheitsschutz durch und gegenuber dem Sozialstaat. Denn der Dienst der Freiheit bestimmt verfassungsunmittelbare Mindestanforderungen an den sozialen Staat, markiert aber auch die Grenze des jedem sozialstaatlichen Geben vorgeschalteten Nehmens. Fragen nach sozialen Grundrechten oder nach der Begrundung eines Existenzminimums finden so ebenso sinnvolle Antworten wie solche nach den Grenzen sozialstaatlicher Umverteilung.
