El presente libro se basa en otro de Ramiro Ávila Santamaría llamado El neoconstitucionalismo transformador, que tiene un subtítulo: El estado y el derecho en la Constitución de 2008. Quizá tengan razón Roberto Viciano Pastor y Rubén Martínez Dalmau cuando afirman que neoconstitucionalismo no es producto de años de teorización académica, sino un fenómeno surgido en el extrarradio de la academia, producido más por las reivindicaciones sociales que por los profesores de Derecho Constitucional. De manera que carece de una cohesión y de una articulación como sistema de análisis y proposición de un modelo constitucional. Eso fue lo que me llevó al análisis de la Constitución española de 1978, en concreto al de su Capítulo III, donde la Constitución sin dejar de serlo, cuando menos en parte, adquiere una dimensión diferente de la habitual, pues regula allí los derechos sociales y lo hace de manera programática.

O cenário global em que o Constitucionalismo Latino-americano surgiu é o de metamorfose, pois algumas certezas sociais se esvaziaram ao mesmo tempo em que algo novo emergiu. A obra reflete sobre o Direito Ecológico Ambiental Transnacional na hipermodernidade e na transmodernidade, diante da crise civilizatória atual, a qual culmina na necessidade de mudança paradigmática em direção à sustentabilidade-centrismo, sem revolução, mas com uma reforma estrutural. Buscar soluções externas para problemas internos não é um caminho profícuo, visto que a América Latina possui cultura, economia e experiências próprias. Sendo assim, o que se tem na região é um constitucionalismo transitório, fracionado em períodos que vão desde o ano de 1982 até os dias atuais. Este Constitucionalismo é um modelo em construção, pois se consolida da prática para a teoria, possui algumas limitações e, além disso, conta com o desprestígio da consciência latina em âmbito internacional, uma vez que esta emancipação/autonomia colide com o fornecimento de mão-de-obra e matéria-prima barata para nutrir muitos países fora da América Latina. Entretanto, fato é que apesar dos percalços, é um despertar para a maior integração social, para a formação de uma identidade latino-americana, para a redução das desigualdades e da pobreza, ainda que no contexto capitalista e neoliberal. Além disso, nesta obra se percebe que a constitucionalização dos Direitos da Natureza abre caminho não apenas para difundir o Neoconstitucionalismo Transformador, mas para promover o Neoconstitucionalismo Metamorfósico. Este volume também oxigena o protagonismo da sustentabilidade, pois o comportamento agressivo do ser humano promove desarmonia com o meio ambiente, de modo que o homem é o causador, mas não é a única vítima dos efeitos do abalo no equilíbrio. Sendo assim, é urgente mudar a postura que extrai da Natureza muito mais do que o necessário para a subsistência. Para tanto, o plano jurídico confere coercibilidade na execução da transformação, mas é insuficiente, de modo que é necessário um panorama integrado para uma renovação paradigmática, o que atrai as vias da sustentabilidade em um novo modelo de desenvolvimento a fim de auxiliar na reforma da conduta humana. Esta ideia de desenvolvimento precisa ser renovada e coligada com o que se pode chamar de prosperidade integral que, além de afastar riscos ecológicos impostos para a América Latina, auxilia no combate aos malefícios da matriz econômica extrativista, que acompanha esta região desde o período colonial, em direção ao pós-extrativismo.
