Based on over a decade of research, this book examines the social harms of Australian prescription and non-prescription medicine regulation and how these ultimately stem from neoliberalism and its reinforcement of state and corporate power. Neoliberalism shapes state and corporate power, regulation and the harms resulting from regulatory failure, yet the links between these themes are rarely discussed. Drawing on the concept of hegemonic neoliberal governmentality, this book critically examines Australian medicine regulation and the harms resulting from its failure in areas such as medicine quality, safety and efficacy; direct-to-consumer advertising; and marketing directed at health professionals. It traces these harms through the colonial foundations and evolution of medicine regulation in Australia, exploring both regulatory failure and the attempts at reforming this regulatory system. It argues that neoliberalism is not regulatable and reinforces and sustains itself, empowering the state and corporations while disempowering the public and those representing its interests. Thus, reducing its harms is only achievable through broader, transformative change, rather than by reforming (and thereby continuing to work within) the existing neoliberal capitalist system. Refinery explosions. Accounting scandals. Bank meltdowns. All of these catastrophes—and many more—might rightfully be blamed on corporations. In response, advocates have suggested reforms ranging from increased government regulation to corporate codes of conduct to stop corporate abuses. Joshua Barkan writes that these reactions, which view law as a limit on corporations, misunderstand the role of law in fostering corporate power. In Corporate Sovereignty, Barkan argues that corporate power should be rethought as a mode of political sovereignty. Rather than treating the economic power of corporations as a threat to the political sovereignty of states, Barkan shows that the two are ontologically linked. Situating analysis of U.S., British, and international corporate law alongside careful readings in political and social theory, he demonstrates that the Anglo-American corporation and modern political sovereignty are founded in and bound together through a principle of legally sanctioned immunity from law. The problems that corporate-led globalization present for governments result not from regulatory failures as much as from corporate immunity that is being exported across the globe. For Barkan, there is a paradox in that corporations, which are legal creations, are given such power that they undermine the sovereignty of states. He notes that while the relationship between states and corporations may appear adversarial, it is in fact a kind of doubling in which state sovereignty and corporate power are both conjoined and in conflict. Our refusal to grapple with the peculiar nature of this doubling means that some of our best efforts to control corporations unwittingly reinvest the sovereign powers they oppose.

State Capitalism under Neoliberalism analyzes State capitalism in agri-food under neoliberalism and investigates State-sponsored actions designed to counter the negative consequences of the implementation of free-market policies and strategies. In particular, it probes efforts of the Brazilian State to respond to the neoliberalization and corporatization of agriculture and food. Between 2003 and 2016, the left leaning Workers’ Party (Partido dos Trabalhadores) governed Brazil, which claimed to support landless peasants, family farming, food sovereignty, and State regulation of the unwanted consequences of the evolution of free market capitalism. The contributors analyze these actions of the Brazilian State, stressing its accomplishments and limits, and argue that the emancipatory actions of the Brazilian State engendered a complex and contradictory set of results which show that State capitalism is a problematic solution to the problems generated by the global neoliberal regime.
