Analisar o Direito do Trabalho e seu conjunto de mudanças pode, muitas vezes, nos levar à cegueira de não buscar interpretar este fenômeno de forma macro, inserido em uma estrutura social de causa e efeito. Quando contextualizamos este caminhar desregulamentador, muitas vezes deixamos de ponderar sua ocorrência, por exemplo, no interior da fragilização da democracia material. O discurso econômico hegemônico, que busca naturalizar a inevitabilidade das mudanças, não inclui na sua retórica o impacto da segregação de direitos e a marginalização de um enorme contingente populacional. Estes indivíduos, diante da ausência de esperança, passam a aderir a discursos neopopulistas autoritários, amparados na premissa de autopreservação, independentemente da consequência de sua escolha para o coletivo. Aderem usualmente ao discurso "menos direitos e mais trabalho", optando por agentes que fazem uso da via democrática formal para a corromperem internamente, fragilizando as instituições. Relativiza-se assim a estrutura coletiva de proteção e solidariedade, caminhando para o isolacionismo que a individualização nos impõe. Entender a existência de um sistema protetivo trabalhista e social como meio de defesa do pluralismo é um exercício vital para a tutela da democracia constitucional.

In much of Latin America, disenchantment and cynicism have set in regarding the quality of elected governments raising the prospect of a new round of democratic erosion and breakdowns. One of the important emerging challenges for improving the quality of democracy resolves around how to build more effective mechanisms of accountability. A widespread perception prevails in much of the region that government officials are not sufficiently subject to routinized controls by oversight agencies. Corruption, lack of oversight, impunity of state actors, and improper use of public resources are major problems in most countries of the region. Dealing with these issues is paramount to restoring and deepening democratic legitimacy. The fundamental question in this volume is how democratic leaders in Latin America can improve accountability while simultaneously promoting governmental effectiveness. These issues have acquired urgency in contemporary Latin America because of heightened public concern about corruption and improper governmental actions on the one hand, yet on the other, uncertainty about the potential tradeoff between tightened accountability of officials and effective policy results. The volume enhances understanding of three key issues. First, it enriches understanding of the state of non-electoral forms of democratic accountability in contemporary Latin America. What are some of the major shortcoming in democratic accountability? How can they be addressed? What are some major innovations in the efforts to enhance democratic accountability? A second contribution of the volume is conceptual. Accountability is a key concept in the social sciences, yt its meaning varies widely form one author to the next. The authors in this volume, especially in the first four chapters, explicitly debate how bet to define and delimit the concept. Finally the volume also furthers understanding of the interactions between various mechanism and institutions of accountability. Many of the authors address how electoral accountability (the accountability of elected officials to the voters) interact with the forms of accountability in which state agencies oversee and sanction public officials. The majority of citizens in the world today do not trust their political representatives, the mainstream political parties, the established political institutions or their governments. This widespread crisis of legitimacy underlies a series of dramatic changes that have taken place in recent times in the global political landscape, such as the unexpected election of Donald Trump, Brexit, the demise of traditional political parties and the election of a political outsider in France, the transformation of the political system in Spain (including the secessionist movement in Catalonia), the rise of the extreme right in Europe and the nationalist challenges that threaten the European Union. The French Constitutional Council, a quasi-judicial body created at the dawn of the Fifth Republic, functioned in relative obscurity for almost two decades until its emergence in the 1980s as a pivotal actor in the French policymaking process. Alec Stone focuses on how this once docile institution, through its practice of constitutional review, has become a meaningfully autonomous actor in the French political system. After examining the formal prohibition against judicial review in France, Stone illustrates how politicians and the Council have collaborated over the course of the last decade, often unintentionally and in the service of contradictory agendas, to significantly enhance Council's power.
