Nation-Building and Federalism in Nepal primarily deals with the presentation and elucidation of identity-based federalism, a unique concept and a novel form of federalism. The most notable source of first-hand information was garnered through the author's involvement in constitution-making by proxy, as a member of the High-Level State Restructuring Recommendation Commission and as a facilitator of several interaction programmes conducted in dialogue form: that is, dialogues with citizens, stakeholders, members of the Constituent Assembly, office-bearers within political parties (intra-party), and leaders across the parties (inter-party). This volume provides a holistic overview of the long peace process in Nepal following the signing of the Comprehensive Peace Agreement (CPA) in 2006. The date of 21 November 2021 marked the 15th anniversary of the Comprehensive Peace Agreement (CPA) which concluded the decade-long civil war that had ravaged Nepal. Despite avoiding a resurgence of statewide conflict, Nepal’s post-conflict era has been far from perfect. This era has witnessed ethnic violence, rampant corruption, the politicisation of key public institutions and a failure to fully implement the provisions of the CPA. The resulting lack of socio-economic progress has led to large-scale dissatisfaction within the country and even given rise to elements within Nepal who reject the framework of the CPA and the 2015 constitution. With a focus on the years following the 2015 constitution, this book offers an analysis of post-conflict Nepal and explores issues relating to ex-combatants, transitional justice, women, socio-economic affairs, and federal governance. The contributors are all scholar-practitioners, some of whom had direct involvement in the peace process, and are therefore able to offer unique insights into the processes and challenges of Nepal’s long journey to addressing past grievances and promoting future peace in the country. This book is a detailed account of how hierarchy has been maintained historically by the Nepali state, affirming the uniqueness of a caste-based social order by bringing outsiders, especially ethnic groups and religious minorities, into the caste fold. Focusing on the contemporary state of Dalits, the community that was and is put at the bottom of a very hierarchical social order in Nepal, the author argues that the traditional caste-based social order is still prevalent in the “new” Nepal even after the recent socio-political and constitutional changes. Illustrated by scientifically employed and interpreted data mainly in the three sectors of education, politics and employment, the book postulates that people who were and are born into the “high caste” still have more access to the resources and opportunities available in society in comparison with those born into the “lower” caste. It further argues that although reservation policies are in place to address social exclusion, these could not bring expected outcomes mainly due to the lack of engagement, if not ignorance, of both dominant groups and the community in the margin. The absence of clarity among political actors on the positive discrimination and affirmative actions has contributed to backtracking the recently created space in line with “inclusive Nepal”.
