As part of their regional integration measures, the members of the Association of Southeast Asian Nations (ASEAN) entered a commitment to remove non-tariff barriers and harmonize non-tariff measures by 2015. Despite this, non-tariff measures have steadily increased in the region.This paper examines the non-tariff measure incidence in ASEAN within the context of the structural changes which occurred in the region during the 1990s. The 1990s was a period of tariff liberalization and outward-oriented policies. These marked the transition of these countries from agricultural to increasingly manufacturing countries. The importance of production network-related trade for ASEAN countries makes the rising incidence of non-tariff measures even more noteworthy. On one hand, non-tariff measures can signal the quality of products of processes, thus stimulating demand. On the other hand, non-tariff measures can act as disguised protectionist measures. Are the ASEAN non-tariff measures motivated by a desire to protect industries which are adversely affected by recent structural changes? Or are these non- tariff measures promoting and enhancing these countries' participation in production networks?Using a qualitative approach, this paper examines the trends in the imposition of non- tariff measures vis-à-vis the characteristics of the ASEAN Members. The trends in this region provide evidence for both scenarios. That the rising incidence of non-tariff measures coincided with increased participation in production networks supports the argument that these measures promote trade by signaling quality. However, the incidence of non-tariff measures in declining industries suggest that protectionist motives may be at play. These results imply that the idea that non-tariff measures need to be harmonized and even eliminated to promote trade needs to be reexamined.

The focus of this report is particularly on the consequences of non-tariff measures (NTMs) for developing economies and also South-South trade. This is because (i) barriers to South-South trade need to be tackled if it is to fulfil its potential as a future driver of growth; and (ii) regional developing economies are increasingly the source of new NTMs as well as being their 'victims'. Chapter 1 provides an overview of global and regional trends in trade, tariffs and non-tariff measures and highlights the growing importance of NTMs. Chapter 2 surveys methodological problems that arise when evaluating NTMs and trade. Chapters 3 and 4 consider in more details two of the most prominent and widely-used types of NTM, respectively Sanitary and Phytosanitary (SPS) Measures and Technical Barriers to Trade (TBTs). Chapter 5 concludes by reviewing mechanisms for streamlining NTMs and promoting developing countries' trade, particularly at the regional level

This thesis aims to shed light on the persistence of non-tariff measures in ASEAN (Association of Southeast Asian Nations). It begins with an analysis of the issues on compliance with, and effectiveness of, the region’s international law instruments relating to non-tariff measures. The persistence of non-tariff measures may be due to the trade regime’s inability to provide the Member States with sufficient incentives to comply with their obligations. This is followed by a look into the Member States’ underlying motivations. It is noteworthy that the persistence of non-tariff measures coincided with significant structural changes in the region’s economies. This thesis shows how these structural changes may have influenced the preferences of different actors in the Member States for non-tariff measures. The last part of this thesis builds upon these insights and extends the analysis to an examination of the underlying determinants of trade policy in the region. The results indicate that economic factors do matter. Additionally, the degree of political insulation and accountability may affect how governments respond to these societal preferences, as reflected in laws, policies, and regulations. Thus, non-tariff measures persist in ASEAN because its trade regime failed to overcome the policymakers’ interests in catering to the societal preferences for different kinds of trade measures.

The Design pillar evaluates how suitable the NTM has been/can be for meeting the stated objectives; Implementation assesses the efficacy of procedures and costs of implementing the NTM; and Compliance measures how burdensome the NTM is on the private sector. The toolkit relies on active engagement with the stakeholders who have to comply with the NTMs and oversee its day-to-day implementation. The goal at all points is to streamline NTMs to achieve public policy objectives at the lowest possible cost.

This study seeks to investigate empirically the directional impacts of NTMs on intra-ASEAN exports given that not all NTMs pose constraints to trade. Though NTMs are found to be diverse and intense for specific bilateral pairs, there is no empirical evidence of adverse impacts of NTMs on intra-ASEAN exports. Instead, the findings of the study based on an augmented gravity model suggest that NTMs promote intra-regional exports, irrespective of broad commodity types. The popular perception of the pervasive nature of NTMs, based on the frequency and types of NTMs, is plausibly flawed as the export coverage of NTMs for the various bilateral pairs is not astoundingly high to deter intra-regional trade. This study therefore informs the policy debate on the non-issue of NTMs per se in posing any significant market access problems for intra-ASEAN trade.
