The Theory of Contestation advances critical norms research in international relations. It scrutinises the uses of ‘contestation’ in international relations theories with regard to its descriptive and normative potential. To that end, critical investigations into international relations are conducted based on three thinking tools from public philosophy and the social sciences: The normativity premise, the diversity premise and cultural cosmopolitanism. The resulting theory of contestation entails four main features, namely types of norms, modes of contestation, segments of norms and the cycle of contestation. The theory distinguishes between the principle of contestedness and the practice of contestation and argues that, if contestedness is accepted as a meta-organising principle of global governance, regular access to contestation for all involved stakeholders will enhance legitimate governance in the global realm.

This open access book delves into the responses of EU actors, such as member states, institutions, and political groups in the European Parliament, to the fragmentation of the liberal international order (LIO). Among these interpretations is the concept of strategic autonomy, which has emerged as a key feature of debates surrounding the EU's adaptation to a fragmented LIO. The contributors examine these dynamics across different issue areas and dimensions of EU foreign policy, encompassing the Common Foreign and Security Policy (CFSP), external relations, and the externalization of internal policies. They use the term fragmentation to refer to a bundle of processes affecting the LIO that range from challenges to the universality of human rights to the crisis of global governance instruments, from the bifurcation of tech to protectionist tendencies in trade policies.

The European Union's foreign policy and its international role are increasingly being contested both globally and at home. At the global level, a growing number of states are now challenging the Western-led liberal order defended by the EU. Large as well as smaller states are vying for more leeway to act out their own communitarian principles on and approaches to sovereignty, security and economic development. At the European level, a similar battle has begun over principles, values and institutions. The most vocal critics have been anti-globalization movements, developmental NGOs, and populist political parties at both extremes of the left-right political spectrum. This book, based on ten case studies, explores some of the most important current challenges to EU foreign policy norms, whether at the global, glocal or intra-EU level. The case studies cover contestation of the EU's fundamental norms, organizing principles and standardized procedures in relation to the abolition of the death penalty, climate, Responsibility to Protect, peacebuilding, natural resource governance, the International Criminal Court, lethal autonomous weapons systems, trade, the security-development nexus and the use of consensus on foreign policy matters in the European Parliament. India and the European Union bear a particular responsibility: as international relations change, not least because of the global COVID-19 pandemic, the two largest democracies in the world have the unique potential to jointly demonstrate that trusting cooperation and mutual understanding are both indispensable and fruitful—all the more so in the context of increasing national egoism and disregard for the fundamental principles of multilateralism. This realisation is not new. Believing in the necessity and mutual benefit of close cooperation, India and the EU struck a strategic partnership in 2004. But resounding success in forging closer bilateral ties and promoting an inclusive, rules-based global order has proved elusive. Since 2016, however, the EU’s Global Strategy has offered new opportunities for a restart of European foreign policy, envisaging new partnerships and recalibrating existing ones. On India’s part, too, changing stances have presented new openings—with New Delhi criticising protectionism and calling for a strengthening of multilateralism. This timely book scrutinises the status quo and the future potential of revitalised EU-India relations. Over recent decades International Relations scholars have investigated norm dynamics processes at some length, with the ‘norm entrepreneur’ concept having become a common reference point in the literature. The focus on norm entrepreneurs has, however, resulted in a bias towards investigating the agents and processes of successful normative change. This book challenges this inherent bias by explicitly focusing on those who resist normative change - norm ‘antipreneurs’. The utility of the norm antipreneur concept is explored through a series of case studies encompassing a range of issue areas and contributed by a mix of well-known and emergent scholars of norm dynamics. In examining the complexity of norm resistance, particular attention is paid to the nature and intent of the actors involved in norm-contestation, the sites and processes of resistance, the strategies and tactics antipreneurs deploy to defend the values and interests they perceive to be threatened by the entrepreneurs, and whether it is the entrepreneurs or the antipreneurs who enjoy greater inherent advantages. This Brief uses the theory of norm contestation as a model for understanding variation in norm-related behavior in international relations. While most typical approaches to understanding norms view norms as stable structures and actor responses to them as unquestioned, in a global political climate where departures from expected behavior may occur, a more nuanced model is needed. By using a norm contestation framework that highlights norm fluidity and actor agency, this book expands the discussion, providing insight into divergent interpretations of norm violation and compliance and the dynamic nature of norms. The first two chapters introduce the norm contestation model, explain how it contributes to the literature on norm violations, and discuss the reasons for the cases discussed. Chapters Three and Four provide detailed case studies of the mechanisms of norm contestation as they apply to the civilian immunity and non-intervention norms. Chapter Five concludes by reconnecting the norm contestation model to the case studies and describing how it can be applied to norms other than those regulating armed conflict. This book elucidates the link between the politics of a now seemingly permanent crisis in Europe and the politicisation of European integration. Looking at the epistemic dimension of crises, it suggests that the way in which a crisis is framed and contested determines its potential impact on the level of politicisation of European integration. Europe is more challenged and contested today than it has even been, facing crisis of an almost existential kind. Yet, political crises are manufactured and narrated, so Europe has the possibility to intervene and ‘bring about her recovery’, instead of letting these crises prove terminal. This book explores the political process in and through which certain events come to be framed as constitutive of a moment that requires a decisive intervention. It shows that crises require a double framing: a situation needs to be identified as one of crisis in the first place and, subsequently, the nature and character of the crisis need to be specified. By examining a wide range of policy areas, the book demonstrates that framing of crises, i.e., identifying one situation both as a crisis and a crisis of a particular kind, contributes to the politicisation (or depoliticisation) of the process of European integration. The chapters in this book were originally published as special issue of Journal of European Integration.
